Fraudulently sells opened video games

Best Buy refused to exchange a game I returned unopened about 2 weeks ago. They stated it was open and it was not. I was exchanging the game for another one within 24 hours and mine was unopened. It was a gift for a friend and he had the one I bought already. I went round and round with a young sales clerk who took it to the manager who pretty much called me a liar and said it was opened, not being able to prove it to me.

I said if it was opened it was opened when I bought it. He said it is a violation of copyright laws but several other stores exchange opened games so that must be a lie. My game wasn't opened by me anyway. I am 46 years old and could care less about the video game but thought this whole ordeal sort of frustrating. I left the game with them when I tossed it over to a desk and said "your customer service sucks".

I had not been that upset in a while, I'm usually a pretty calm person. I had been in line for 35 minutes when I finally got called which I'm sure added to the frustration. I had bought hundreds of dollars worth of items from them but I guess that must be irrelevant. My son had a problem with an item at Circuit City that he said they probably could'nt help but when they saw he had spent $2300 with them in the past 3 years, they fixed it no questions asked.

Guess I'm shopping at the wrong store. Well, why I am posting this complaint, when I went back to the store the same game I returned was on the shelf. Easily recognized because of a recognizable blemish on the face on the box. I went home and got the $400 digital camera, you guessed it, bought from Best Buy like an idiot and took a picture. It was the only game of that type on the shelf.

My brother who is a computer geek says this is common practice with them and has been going on for ages.
I won't buy from Best Buy anymore. I just bought a $1800 HDTV from Circuit City and would have probably bought it from Best Buy had they exchanged the stupid $20 game. No refund, just an exchange, for a more expensive game at that. I am thinking for retaining an attorney because they basically called me a thief, cheat and liar that day with no evidence.
