EMS promised to provide an On Line Store Training and Marketing and provided shareware and nothing more

The compnay EMS, agreed to provide me and on line business with all the necessary software, materials, and training and they also said they would "do the internet marketing for me in the beginning" to get my business up and running. They guaranteed to work with me until I go my investment back.

The most important part of the transaction for EMS, Inc. Was receiveing the money. They required a Balance Transfer from a credit card rather than a regular card charge to complete the deal. Until the "check" from the credit card was in their hands they would not ship the "materials." The first software was a business kit with all the necessary stuff to set up an online business. When they did ship the materials, it was a $10 piece of shareware that did not work and did not provide near enough information to start a legimate corporation.

The contract I signed was a standard boiler plate that pretty much protected them to the end of the world and gave me no rights at all. I did sign it and return it to them, but I cited the fact a principal of their company had to sign it and return it to me to make it a binding agreement. When they did FAX me a copy of the contract it was not the one I signed and my signature was not on it. Furthermore, the contract the "principal" signed was blank. None of my information was on it and none of our terms were on it. As of this report we do not have a binding agreement.

They did grant me access to on line software but it was not the software specified in the contract. The software I was granted access to was out of the box multiple user stuff that was very limited in it's ability. The training they offered was provided by a sub contractor that took no responsibility for any of the things that EMS promised. The training coaches had no knowledge of what I was supposed to get and what I needed I had to find on the internet and purchase myself. The marketing they promised never came, as well as several other items agreed to in the contract.

I FAXED a letter to the company and followed it up with a certified copy. On the day the letter was reveived a got a telephone call from one of the office staff that said I could not cancel as my three day right of recision had expired. She said she would look in to it and I would get a call back that day. Of course that never came.

My certified letter was received by the same guy who signed our blank contract and he called me at home on a Saturday afternoon. The tone of the call was set from the onset and he was harassing and arrogant. He sated that my letter made him angry and if they were a scam why would they try to help me. I am in law enforcement for a living. I citied my profession to these pepole on several occassion and that I suspected they were operating a scam. The guy who called me made the statement that if I were any good at my job, I would have discovered he didn't own the place, he just runs it. When I detected our call was on speaker phone he stated their attorney was present with him; but the attorney would not speak or identify himself.

This operation appears to be a bait and switch operation. They take your cash and promise the moon and hide behind the fact they have given you everything you were promised. The problem is the "stuff" they give you is in no way what was promised. This is a company to avoid at all costs. I will be pursing this matter legally; but knowing how "contracts" go I fully expect I just got a $5000 education.
