PLIMUS Refuses to issue refund for Box Product that was never shipped

Our company's eMac crashed and we had purchased Stellar Phoenix Macintosh Data Recovery to retrieve our data. The only thing they sent was a download link to download the software and per the email they sent with the order details, the email read like this:

Thank you for your purchase of: (1) - Stellar Phoenix Macintosh Data Recovery - Single User Download You will receive the Box Product (Regular Application Boot DVD) from Stellar. Stellar dispatches the box on the same OR next business day from the date of confirm order. Registration Steps for Download Version: Regular Application: Your Registration Key is: 44525349534C344D41434452* http://www.stellarinfo.com/pmac4.0.1.0. Dmg. Zip Registration Steps: 1. Please download the software from the link below: http://www.stellarinfo.com/pmac4.0.1.0. Dmg. Zip After the successful installation when you run the application, registration process window appears. 2. Please click on Register Now 3. Please enter the Registration Key and click OK to continue. 4. You will get the message Product is Registered Successfully. Boot DVD: Boot DVD will be physically shipped to you by STELLAR File Size: 600 MB With Phoenix Boot DVD, you can simply boot your system by following these simple steps: 1.insert Stellar Phoenix Macintosh Boot DVD in DVD drive and restart your computer. 2. Press C key continuously to boot your system from DVD. 3. The License Agreement screen of the software will appear. Click I Agree button and you will get into Recovery Options screen of the software.

After waiting 2 weeks for the bootable dvd, we contacted the company. After several frustrating attempts to contact their customer service with no answer, we left messages which were also never returned. I opened a case with PayPal to try to get some type of response and the response was nothing more than someone repeatedly telling us to go to their site to request a refund. I requested the refund through PayPal which the company quickly denied, and then immediated requested the refund through their website. This morning I get an email from their department stating this:

Hi, Thanks for your mail, Regarding your concern, I would like to inform you that we can not consider your refund request. As per our refund policy, a client is entitled for refund if... - Client is able to see the data with demo version and not able to recover them back with full version and if... - Our technical support wing opines that no recovery is possible due to any software limitation. Please get back to us for any further query. Thanks, Pritee Stellar Information Systems Limited

What a load of crap! Right now as it stands we are currently out the $99 they charged us for software they know we can't use.in the meantime I ordered Diskwarrior which arrived in 2 days and brought our eMac back to life!
