Hosting Scam

(Sorry if this is in the wrong forum.)

A month ago I got a dedicated server from NetDepot. Before I could even begin the transfer of my old server, the harddrive died and had to be replaced. Understandable I guess, I figured they'd just used a bad drive on a new server.

It's replaced, then I begin the transfer again and several days into it, the drive dies AGAIN. Takes another week to start over and complete the transfer. Now I get about 5 consecutive days where things seem to be working. I pay my second invoice even though half of this invoice was wasted because of their broken hardware. I really should've quit after the second dead drive, I must not have been paying attention.

About a day after I pay my second invoice, all websites stop working. My server maintenance company says the HDD went into read-only mode which is usually indicative of a dying drive. "Surely it can't really be dying for the third time in less than a month, " I thought. I raised a but of hell with the tech support and asked for reassurance, because what's the point of having a server if your data lasts a week before the drive dies? They tell me they need to do an fsck, which they do, and the tech is actually real patient in explaining the problem, except that he says nothing at all is wrong, despite that it's contrary to what my server management company said and the odds, which say there is DEFINITELY a problem with the drive since there were 2 problems in 3 weeks.

By that point I don't trust my data on these servers and I decide to go elsewhere. I submit a ticket to their sales tech support explaining the situation and asking for a refund, and soon I get a reply which says simply that my invoice should be updated to reflect whatever changes they made. I login and see that nothing's been changed at all. I call their phoneline at about 4pm on a business day but get no answer; I leave a message. The next day it's about 2:30pm and still no reply. I call again, no answer. I submit another ticket to sales saying I called and couldn't get ahold of anyone, I just want a refund.

I get a response from the sales lead saying they don't give refunds, and I have no reason to be upset since this server was marked as a "bargain" server which, according to him, means it runs on older hardware which is less dependable. Are you serious? They KNOWINGLY sell me broken hardware and then refuse to issue a refund? He also tried to pitch me a server at three times the price saying I'd get a discount for the next month or something, but I didn't even read that part of the email. I'm understandably pissed at this point, so I reply that no, that's definitely not what I want, and there's NO reason for them to tell me they can't issue a refund for an invoice which HASN'T EVEN STARTED YET. After that, I do get a refund for next month's invoice, but I still lost the money for last month's plus a lot of wasted time.

Today I got an invoice saying I was billed $40 for the fsck procedure. Absolutely unreal. This company should not be able to conduct business. To be any more of a scam they'd have to not actually possess any server hardware.
