Ms. Bern Of DentaBright Billed me when trial period was not up... Billed me and product was not received, henced not tried

On July 30, I signed up for a 15 day trial offer from Dentabright.

On August 8, after having not received the product, I called DentaBright to query if and when the product was sent. I spoke with Ms. Bern.

I communicated to Ms. Bern that I signed up for the 15 day trial membership, but after 1 week I have not received the trial kit. Hence, I needed to know when/if the kit was sent. Ms. Bern, then told me, that I had in fact signed up for a 7 day trial membership, that they do not offer 15 day trial offers. Also, the trial kit was sent, but, she was unable to say when it was sent as they do not record that information. She also advised me that in light of not having cancelled my membership, another kit was sent and they have billed me $39.99.

At this point, I becamse livid, because:

1. I had not received the trial kit
2. I KNEW that what I signed up for was a 15 days trial membership. I am sure of this because I had written the information down.

I proceed to explain to Ms. Bern that I signed up for a 15 day membership, however, she was like a recording and would not accept what I was saying, but continued to tell me that they do not offer 15 days trial offers. She told me that I should wait on the second package to arrive, and then return it to their office. I asked to speak with a supervisor, but while waiting, I got disconnected.

I called back and was able to speak with a supervisor by the name of Noel. I explained the situation to him, and like Ms. Bern, he told me that their records indicate my membership was a 7 day trial offer. I explained to him that todate I had not received the package. He too was unable to say when it was mailed, but he added he would investigate the matter and let me know. I told Noel that I KNOW what I signed up for, and I would get the proof and get back to him.

I went back online and decided to read the TERMS OF CONDITIONS on Dentabright.com. Guess what! This was what their TERMS OF CONDITIONS said:

15-day trial period includes shipping and transit time

You are not obligated to purchase after you receive your free trial kit and you may cancel anytime by calling 1-800-419-0737 Monday thru Friday 8AM-4PM Pacific Standard Time within the 15-day cancellation period. Even if you decide to cancel, please keep the FREE kit as our gift to you. You will never be billed.

Unless you call to cancel, you'll continue to get a fresh seven-day supply of DentaBright Teeth Whitener every 30 days for the low price of $42.90. You can cancel anytime".

I called back Dentabright and spoke with Noel and told him that their website said the offer was for 15 days. He took the information and told me that he would contact his H/Q and advise them of the situation, and that I should be refunded the full amount. He requested that the 2nd shipment be returned. I told him that I need to know who will pay the shipment, because it will not be me. He told me to contact their office once I have received it, and they will make arrangements for it to be shipped.

These people are misleading consumers and I am still hoping I do not have any problems getting back my money.

What I am upset about is being billed when I shouldn't have and being told that I signed up for something I did not.
