They never shipped the item and they refuses to answer emails and phone calls They won't cancel the item and they lied and said they shipped it

Mookie Gifts - also known as D & S Giftware - run by Daniel B. Corkery - has not shipped the items i ordered. Not only that, they then lied and said they did even though they couldn't provide a tracking number. They have had many Better Business Bureau complaints. Here's a sampling:

Online gift retailer fails to deliver

St. Louis, Mo., May 14 - A Florissant, Mo., consumer ordered a gift from on-line merchant D & S Giftware's Web site, mookiegifts.com, in early December. She reported paying $23.97 by check for a figurine that never arrived. Her numerous calls and e-mails to the company went unanswered, prompting her to contact the Better Business Bureau (BBB). The firm, located at 503 E. Nifong Blvd., #157, Columbia, Mo., told the BBB the consumer's payment was never received. The consumer received a copy of her cancelled check from her bank. The check was endorsed by HBM, LLC.

In the past six months, the BBB has received 31 complaints and reports against D & S Giftware. Because it failed to resolve or respond to numerous complaints, the company has an unsatisfactory BBB report. Consumers state the company failed to respond to consumer inquiries about orders and deliver orders, and that they were unable to reach the company by telephone. Other consumers report the company failed to provide shipment tracking numbers, provide refunds, and ship orders with expedited shipping as specified by consumers.

An Indiana consumer reported D & S Giftware to the BBB after ordering a gift that was never received. He paid $61.95. He told the BBB he initially thought they were backed up due to Christmas, but left messages and sent e-mails asking about the order, none of which were answered. The company told the BBB the item was refused and the consumer's credit card was refunded. The consumer disputes the company's response, and maintains he did not receive a refund or the order.

An Illinois consumer told the BBB she ordered a Giggle Gear Mega Mask for Boys from D & S Giftware's Web site on Dec. 7. The mask did not arrive and the company did not respond to her e-mails and telephone calls about the status of the order. She requested the order be cancelled but received no response. The company replied to the BBB that the order was delivered to the consumer on Dec. 23, yet the consumer states she did not receive the mask.

H.B.M., LLC is listed as the owner of D & S Giftware, according to the Missouri secretary of state's Web site. Daniel B. Corkery is identified by the Web site as the registered agent for H.B.M., llc. The registry lists the company's address as 8000 Marigold Ct., Columbia, Mo. The company's Nifong Blvd. Address was confirmed to be a U.P.S. Store mailbox.

The BBB offers the following general tips for consumers shopping online:

* If you are trying a new merchant, ask the merchant for its physical location and phone number.
* Determine the company's refund and return policies before you place an order.
* Don't be duped by professional looking Web sites. Look for trustmarks or seals from trusted third-party organizations, like the BBB's Online program, indicating the business has met high privacy protection and other safe e-commerce standards.
* Be cautious if you're asked to supply personal information, such as your Social Security number or personal bank account information, to conduct a transaction.
* Print out a copy of your order and confirmation number for your records.
* Know your rights. The same laws that protect you when you shop by phone or mail apply when you shop in cyberspace. Under the law, a company must ship your order within the time stated in its ads. If no time is promised, the company must ship your order within 30 days after receiving it, or give you an "option notice."
* If you pay by credit card, your transaction will be protected by the Federal Trade Commission's Fair Credit Billing Act. If you're not comfortable entering your credit card account number online, call it in to the company's 800 number or fax it.
* Check with the BBB for a reliability report on the business or to register a complaint by calling 314-645-3300 or visiting www.stlouisbbb.org.
