Ebay's complicity in The Case of the Fake Turquoise Necklace SquareTrade, Jewelrydays (screenname at Ebay), and Paypal All Ebay CS (if Ebay has a Customer Service dept.) does is sent the same form letters, some completely irrelvent to the problem

Time 3:27 AM October 26
Complaint involves the following parties: Ebay, SquareTrade, Jewelrydays (screenname at Ebay), and Paypal

To Whom It May Concern:

If you are unable to assist me with this case, then please advise me, as I am at my wit's end. I'm disabled, and I can barely take care of day-to-day activities. I barely have the energy, but I believe that someone should give me my money back, and money for the time & effort that I have spent on this case.

I am not going to apologize if a company occupies the same office building that was occupied by a company with the same name, and a package signed by an employee of "jewelrydays."

Ebay is supposed to have some rules. Apparently, if one is defrauded, or the seller breaks another policy, well, good luck. As stated below, you will get chain mail with form letters. I actually received several e-mails via the Ebay system, asking for a response to several questions (which I had already answered over & over) and there was no link!

The auction was at Ebay. I asked for their assistance. They would not help me, so I'll just go ahead & include them, among the participants in this debacle. They were informed that I defrauded by the seller, Jewelrydays.

All Ebay CS (if Ebay has a Customer Service dept.) does is sent the same form letters, some completely irrelvent to the problem. Even using a credit card does not protect one from fraud.

Actually, I thought that Square Trade is involved with this complaint, as they were involved in the "negotiation." What negotiation? I'm disabled and just wanted JDays (of Ebay) to send a prepaid label so I could give the package to my mail carrier.

Anyway, my gemologist looked at the necklace and verified that it was NOT turquoise, glued in stones, nothing as described. I already had an apt. With her, so I broght the necklace with me, already knowing it was fake.

Bought necklace described below, I was defrauded; returned item with the seller's permission, & it was signed for, they did not return my money.

It was signed by an employee of a "jewelrydays." The package was addressed to Jewelrydays, signed by someone that worked for a "Jewelrydays" This info is on the cc from the USPS in Columbia of the signature/return receipt. I have to check & see the suite or department I was asked to send it back to.

This language sounds so familiar:
" Los ANGELES California *REBUTTAL employee. JewelryDays.com interposes strong objection to these warrantless accusations as the same have no factual basis."

Well, I have facts described herein.

Companies involved: 1) Ebay 2) SquareTrade 3) Paypal (paid using their service, and tried to open a claim, and/or lost, I have to check as there is so much data)

4) Jewelrydays, also known as Bgconcepts, NIKESH RAILKAR (apprantly an employee), Address at time of auction & delivery of item:
550 South Hill Street
LOS ANGELES California 90013
U.S.A.
Phone Number:
800-409-4367 (There were other numbers)

You have to realize the time I spent copying, mailing, filling out on-line and off-line complaints to govt and consumer agencies to no avail.

Paypal is www.paypal.com,

Ebay, www.ebay.com

Here is the description of the item I bid and luckily "won"

RARE! Silver 35CARAT 56GEM TURQUOISE NECKLACE
Bay Payment Sent (ID # 59M4096308636821W) The company was supposed to give me my return postage back, too. Total Amount:
-80.30 USD plus postage

I told PayPal that the item was returned. They would not assist me, although their service was used.

I have the signed receipt; I paid via Paypal. However, I just sent this co. Another e-mail telling them they had two choices to refund my money: Paypal, or a check or money to my home. I again sent an e-mail to one of the addresses above, and guess what, it was not returned!

The saved mail from this incident is from AOL version 7 or 8 on my harddrive. I have the e-mail from one of their company's reps in reponse to telling them I was taking necklace to gemologist, to let her know. Remember, it was supposed to be real? I also have the page saved.

I am disabled. To make matters worse, all the info is on assorted disks, as pcs have failed over the years (that's another complaint). Resurrected bad disk with Bad Copy Pro.

Here is the info: Saw turquoise necklace at Ebay. Saved the page on the hard drive with all info, saved all e-mail inquiries.

Received necklace; it did not look right. Notified them that I was taking it to my gemologist (I had an apt. Anyway). They told me to let them know (remember this was supposed to be real). Gemologist said that the stones were plastic and glued in, not even created stones.

I spent hours on this problem. I even received help form other Ebay customers as witnesses that they were ripped off by this company.

Ebay only gives you 30 days from purchase, not from the day you receive item. Anyway, e-mailed them, told them the outcome. They said they necklace was real.

Sent in at least 3 fraud reports to USPS, received cnfirmation, not a word back. Sent another to another agency, received confirmation, no word. I recently received a form via mail from the post office.

This is copied from my e-mail:

COMMON THEME~SLOW SHIP~POOR QUALITY NO RESPONSE 2 EMAIL DOESNT HONOR GUARANTEE

Response by jewelrydays - Wrong accusations, quality impeccable, we respond 2 all mails within 24 hours.

I emailed them again and again. I have tried to call them. They are now on the web at jewelrydays. I have an e-mail that informed me that they would be opening their own on-line store. If this is a different co., then why did they sign for my necklace?

My fiance took me to work; I returned necklace at Columbia, MD, Post Office, return receipt. Filed for insurance, but someone at the company signed for the necklace. Called & looked at PayPal. My money is not there. The company, Jewelrydays, had "limited use" at Paypal for whatever reason.

I checked for Jewelrydays acct. At Paypal, but I was unable to locate any. I do not think that a "Jewelrydays" has a Paypal acct. I checked, but I'm not positive. I don't care, I paid that way, I want my money back.

Was in arbitration... As I am disabled asked Jewelry Days to send prepaid label, they would not.

My gemologist discovered the quality was not as depicted; for instance, the stones are glued! The retail price of this item was overinflated which made it seem one was getting a deal.

I have the auction page saved on disk. Secondly, as I stated, the stones are fake. My gemologist's name is *.*; web-site, *.*. She provided documentation at no charge to the seller.
