On or around November 22, I signed up on line for a 7 day free trial with FLF; 0nce I arrived at gym I was told that I could do a 30 day trial for my entire family at no cost. I was told that I would be billed initially, but guaranteed a full refund if I decided not to join. When I told them my family included my brother & my niece, and daughters boyfriend, the rep went over and spoke to the manager, they said they would have to enter everyone under my last name, & changed my daughter's boyfriends DOB so he could qualify.

When I asked, he said its just for the 30 days & then if we decided to join, we could go from there. I advised that her boyfriend was under Dr. S and may not be released to workout; I was told that it was easier to take him off than to add him later. I asked if I would be charged anything before the 30 days was up and they rep told me no, not until we joined. The rep told me she was new and had to keep going over to talk to the manager, he helped her enter everything into the computer and then they had me sign a slip and asked for my cc for the trial period.

The rep asked to keep my check card on file and I told them no, I watched her as she was filling out a form and she left it blank when I told her no, & I took back my check cd back from her and instead I gave her my Capital One credit card and told her if I joined I would use my check card and I would sign up for auto pay. She said ok & took my cc, She gave a receipt and a packet.

On my first visit, I asked when the pool was opened for my grandkids; she said she had to check with the manager & told me that kids under 10 were not allowed in the pool. This was a huge disappoint as I was never told that they couldnt swim and in fact I told her we take the grandkids swiming after we work out when I signed up for the trial period. I then called to see about a $15.00 stretch session I was told I could take at anytime, and the front desk told me they were only available on certain days at 900am, and the sessions that were the rest of the time cost $39.00 for half an hour. It was misleading since they never told me anything about it costing more.

In general, I knew within one week that this was not the gym for me and my family. I told the manager that I was not too happy and he said, give it a month and I am sure you will change your mind. Within two weeks of the trial period, On December 6, I was called by FLF and they told me that my cc had been declined and initially I said that the charge went through on my end and my cc shows charges in the amount agreed, and then they said it was declined for the December payment, I told them that I was still under my 30 trail period and I would not be paying anything until my trial was up and only if I decided to join as my agreement. I told them they did not have permission to charge my card and he said my contract has a 5th of the month billing cycle and I told them that after my 30 day trail I would decide, he then stated that he would note my file as refusing to pay.

I told them I would not authorize a charge. I immediately spoke to the manager and he told me not to worry that he would take care of it. I told him, I would not authorize a charge on my credit card and told him I was not too happy about the way things were going and he said give it the 30 days. I filed a cc dispute for the $178.66; I sent a letter on December 9 outlining all that occurred to both Capital One and FLF. I asked for a refund of the $261.41 used to secure my trial period and to cancel. I called to cancel as well. To follow up, I called FLS, they said they never got my letter, but when I told them I also faxed it and have faxed confirmation. They told me that they

Would review it and asked that I mail it again. I mailed a registered letter a second time. I advised them that my cc was disputing the charges but they continue to charge me again in Jan even though I called, wrote and faxed to cancel. I have not used the gym since my 30 day trial period ended around December 22 yet I continue to be charged for services never agreed to or used.

The manager and sales rep at the Beneva location engaged in fraud by signing up members using ficticious dates of births and names. We are lucky that no one was injured during that time because the information on the mebership would not have matched any medical information for my family members.

Do not fall for the lure of the 7 day trial period, once you go in, they will force you on a 30 day period which is anything but that. I am sure I am not the first victim to fall in to this trap. Other states prosecute corporations for this type of fraud.
