Keep in mind that although he may have overcharged for the amount of work he did, no ethical forensic pathologist works on a contingency, and his fee was accepted.
Ethical procedure would be to return a portion of his fee that was not used as actual work time.
Even at $500.00 per hour, which is exhorbitant, he would have to have spent ten hours exclusively reviewing his material— autopsy reports, and photographs, etc.
He has nothing to show for that amount of time. At most a simple review would take a few hours, making his fee way out of line.
The cost for preparation and testimony in a first degree murder trial where the death penalty can clearly exceed $5000, based on a hourly rate, but Dr Goldberg did not prepared to testify or even write a report, memo or anything to indicate that he performed anywhere near $5000 worth of services.
