I too got ripped of by this awful company. However my husband took up the fight. Most people who have complained about this compnay are wrong. They did inadvertently accept terms and conditions, however we have discovered some very interesting facts. The web page only makes mention of a free sample plus postage and packing (usually £3.95) No matter what thay say a free sample is free and under the sales of goods act the product must be sold at the advertised price. Once they take the £3.95 they have accepted that the price is Free. When you proceed to the Payment page to enter your credit card details you will notice that the terms and conditions box is pre checked. This means that the company cannot prove you read and understood the terms and conditions. Had the box been left unchecked you would have been prompted to read the terms and conditions and then check the box to signify you have read and accepted them. On the subject of terms and conditions they are legally bound to make the key points of the contract clear by setting out what the contract is and what your commitment is.in the case of these rouges they bury it in the small print. I (with my huisband support) am in a fight ViV3Labs Ltd to get a refund for the £75.00 they took from my credit card on 15/08/09. So if you have been the victim of this unscrupulous company and the fraudulent practices of it's directors, do not give up. Write to them and make a copy to your credit card company alerting them to the fact that as the terms and conditions box is pre-checked thay cannot be sure you read and accepted the terms and conditions. Also make sure that Free is a stated price and once the transaction is complete it cannot be hiked up. Make a formal complaint to you credit card company as they have a duty of care to make sure that your money is not accessed fraudulently and with the number of complaints on the web right now they should withdraw the credit card facility from this company. This would put Viv3Labs out of business overnight. If they were a legitimate company with ethical practices and good products they would not need to revert to a con of this nature.
