I was browsing the Internet one Sunday afternoon and came across this web-site that offered a two-week free trial of ColonSMART cleanser and promised I would lose amazing weight.
It started with a promise of a $500.00 K-Mart gift card if I would sign up for two offers. I signed up for the colonSMART cleanser and a Christian Bible Study program. I never did receive the gift card either. I was able to cancel the Bible study with no problems.
I was charged $3.95 for shipment of the free trial offer which is pretty standard, but on 04/07/08, I was charged $88.97 for a month's supply that I did not order. I called the company and was able to stop any further shipments. The telephone operator said that instructions would come by e-mail on returning the shipment of a month's supply that I had received. No instructions ever came and the phone was never answered again either. I tried for several days to call someone at ColonSMART and never received an answer. I had used the two-week trial by the instructions that were sent with it and did not have any results. I did not even lose a dress size. I also sent five e-mails that were not responded to.
Finally, by April 22, I sent the package with a month's supply of product back to the address on the label which was the Sun Valley, CA address. I know the package was delivered on April 24, at 8:38 A.M.By the delivery confirmation notice.
There was a charge of $88.97 on my account. The product was returned unopened so it could be resold. It is too easy to get wrangled into this type of deal. I am not signing up for any more "FREE" offers.
I have already filed a complaint with the Better Business Bureau and the attorney-generals for both Kentucky and California with no results. The company did not respond to them.
The company finally did respond to the California attorney-general, Mr. Edmund G. Brown, with this:

Furthermore, it is clearly stated on our website (www.colonsmartcleanser.com), within terms and conditions, what the trial offer implies and what the terms and conditions are, and unless the customer agrees to our Terms and Conditions by clicking on YES I ACCEPT check box on the order page, the customer has
no absolute method of placing the order, in other words, they cannot complete the order. As a result, his/her credit card account was charged accordingly for a 30-day supply which consists of two bottles, and their order was shipped out on the same day. Nevertheless, the customer is able to free to cancel out of this program at any time; this is also mentioned in our Terms and Conditions.
During our communication with our customers, we always ask them kindly to please contact us first for any issues or misunderstanding. However, this customer hesitated to call us first and decided to proceed with this complaint. Nevertheless, this customer's account was cancelled on 04-08-08, and confirmation e-mail was sent to the client. Attached please find a copy of our Terms and Conditions, which explains in detail about our Return/Refund Policy. Also, you will find a copy of the confirmation of delivery by the United States Postal Service and a copy of the order page which clearly shows how the customer typed his/her infornation and clicked on the "I AGREE" confirming that they have read and agree to the Terms and Conditions.
