24-hour Fitness and Business Ethics

When joining 24-hour fitness, please note the contract states the gym is not liable for injury due to equipment or by a person.

My friend got into a verbal argument with someone who was using her cell phone. The argument was heated and the woman splashed water into my friend's face. My friend responded with water. The woman then pushed my friend off the elliptical, which caused bruises to her head, arm and back. My friend stopped the verbal exchange and reported the incident to 24 hour management. An incident report was filed as well as a police report, while the member in question fled the gym. 24 hour Loss Prevention stated that both parties had broken gym rules of using aggressive language and being involed in a physical fight. Both memberships were terminated.

Although my friend broke the gym rule of using aggressive language, she did not injure anyone, but according to the law, splashing water is a form of battery.

24 hour could care less about their members getting injured. Their legal dept. Will try to decrease liability as much as possible. 24 hour does not honour their customers who come to work out, not talk on their cell phones.

I have read of many incidents of potential to actual violence at 24 hour locations, but 24 hour claims no responsibility.

Pay more money - it's worth your safety.
