To whom It May Concern:
I would like to dispute the following amount of $30.00 on my credit card account #4777440064XXXXXX
In the of $30.00 to Balley Health Spa., which appeared on my last statement.
On June 4 I went in the Health Spa to speak with Jennifer Manganiello about joining the gym. Jennifer and I had spoken previously on the telephone on June 3 as I explained my specific needs and requirements for any gym that I would join. My main concern was that I did not want or could not sign a long term contract as my office CDI Professional Services would be moving soon and I did not wish to be locked into a long term contract. Jennifers explanation was that I had three days to get out of the contract if I was not happy. After returning my office I was speaking to another friend and noticed that she in fact recently signed up with the same facility and received a much better rate. On that date June 4, I picked up the telephone and once again contacted Jennifer and told her that I was not happy with the $40.00 per month rate that she gave me and that if she could not provide a better rate I did not require the membership.
Jennifer then stated that after I left that day she remembered a better rate and could not tell what it was
But that I needed to come back in to the facility. At no time did she mention that a $75.00 monthly charge
Would be placed on my credit card as I hadnt even started the work out yet..
I came in again per her request on June 14 which she was not working and saw another gentlemen name
Who provided me with new papers which stipulated a 36 month contract. I explained to him that I did not want this long of a term once again as my office was moving. He then stated that I had until Monday June 17 at 4:00PM as that was when the papers would be processed for the payment to cancel. On June 14
At 10: I contacted Jennifer and told her I did not want this contract and to cancel my membership.
She refused and told me that it was too late but that her manager would contact me that day his name being Juan. As of June 17 at 5: pm there were no calls from her manager or Holiday Spa.
Please read the contract where it states that I may cancel the contract at any time prior to midnight of the third business day which I did. I signed the first contract on June 4. As I stated I contacted Jennifer that day. Then I returned on June 14, where as a brand new contract was written and I canceled on Monday June 17 as Jennifer was not there, I did voice my opinion with her coworker on that day that I did not want the 36 month contract. His answer was to contact Jennifer on Monday June 17 and once again NO PAPERWORK would be processed until later that day after 4PM.
I do not feel that Holiday Spa (Balleys) was legitimate in any way shape or form in the contract that they presented. I asked for at least three to four times a month to month contract only.
Please remove this $30.00 charge from my bill and do not accept any other charges.
