Defective Part Replacement

My son save $200 to purchase a game for his Wii system - the bundle came with drums and pedal, guitar and microphone. The pedal on the drums doesn't not work - straight from the box it does not work. The company will not respond on the telephone and both web site send a canned response to go to Redoctober and follow directions to get it replaced. It is their policy that we pay shipping both directions, insured, to get a replacement. And, it will take 2 - 3 week. Repeated requests for a phone or e-mail response to my other options have gone unanswered.

Can they sell faulty equipment and expect us to pay to have it up and running?
