Ripoff, debited my acct for product they no longer had and have since refused to refund all of my money

There were repeated incidents the first being: upon placing the order on 06-15-04 per the website there were several (95) scooters in stock, as of 06-17-04 i was notified by e-mail that they no longer had the said scooter which by this time i had also paid for via my checking acct. My checking acct was debited the monies on the morning before the e-mail was sent.

Second incident was an issue with the monetary compensation for the misrepresentation of inventory and taking a payment for a product that was not in stock.

Third incident was agreeing to another scooter and upon delivery of the wrong color scooter, we refused shipment due to the damaged appearance of the the box. We could see that the scooter was already cracked through a hole in the box.

It has been 23 days since the shipment was refused and still no refund nor communication via telephone even after leaving several messages on their answering machine.
They have advised me via e-mail after all of their mistakes that they are only going to refund the cost of the scooter and that now i am responsible for the s/h.

Per their e-mail "We cannot refund you the original shipping fee because fedex did not waive the shipping fee. Just like you purchase from a standard walk-in store by tax or bus and you return the item in the end. The walk-in store are impossible to refund you the taxi fee or bus fee. So we have to split the shipping costs with the customer. Thanks for your understanding!"

The refund does not reflect a "splitting" of s/h they expect me to eat the cost of the s/h for a pkg that i refused shipment on because, contray their claim to invest and insure that their packging system would not be a dissapointment to the consumer.

I have copies of all of the e-mail correspondences between myself and samszone that will reflect their way of trying to pacify me in hopes that i would go away only to dismiss that they have obviously taken advantage of me.

I feel that i have been made to wait to long for just a partial refund that has yet to appear in my acct and unjustly treated through out the entire ordeal. I want all of my money back and feel justified in my repeated request. I didnt get what they said i would get.
