Sold item as new but shipped a used one

Purchased a Mars bill acceptor on ebay for a jukebox, this item was listed as new. The item received three weeks after making payment was used.

The seller was contacted on several occasions and as per the seller, the item was returned for a refund. The item was paid for thru paypal and a complaint was also filed with paypal. The complain was a day late and although they reviewed the case they failed to refund my money. The reason given by them was that " PayPal's Buyer Complaint Policy applies to the shipment of goods but not to
disputes about merchandise quality".
