Another ebay seller that should be tossed into the trash can!

This has been a horrible experience for me so far and because of the headache I've gotten from this incident, I'm highly considering not doing business on Ebay anymore. Ebay supposedly has this buyer protection program but has proven to be useless and unreliable.

Back in early September this year I bought 3 items from 128headphones on Ebay. (Earphones, Earphones adapter and earbuds.) I did like any smart ebayer would do before purchasing and researched the seller to check his feedback and see if there would potentially be an issue when ordering through them. Let me tell you something. Feedback percentages are absolute BULLSH*!!! I do realize that there are problems here and there, but not like this.in the listing it said that I'd get my shipment between 2 and 8 business days of payment receipt which he received right away on September 3rd. I ended up not getting my shipment until September 16th which he only sent out after I reported him to Ebay. Well it turns out, 1 of the 3 items I ordered was correct (a pair of earphones of significantly lesser value than I ordered). I of course became enraged because I waited long enough to get these earphones and all without the seller even communicating with me. I immediately contacted the seller and informed him that the item I received was wrong and shipped them back to him the following day which was September 17th. UPS tracking confirmed that he received my return shipment on the 23rd. I waited until the 27th and contacted him again with hopes that he'd ship out the correct pair, but the fool just gave me the original tracking number for the shipment I received on the 16th which were the wrong earphones! I instead of going back and forth with this seller, decided to escalate the issue to Ebay Customer Support of whom state that this "Ebay buyer Protection Program" covers my purchase in case it's arrived damaged, incorrect, missing etc. Well Ebay, after viewing my case for a whole 5 minutes, decided in his favor which makes no sense whatsoever! I demand my money back, but don't know how to go about getting it. I know I'm definitely not the only Ebay victim out there and hope that there is someone who can provide me with the correct means of getting my money refunded. Below are the case details. I even provided Ebay with tracking numbers and photos of the shipment I received which were the wrong item. I DON'T GET IT! HELP!
