Dirty business practices, misleading sales tactics, low quility phones and service

I purchased a refurbished phone 4/10 and the day i set up service the man asked if "i would like to be set up as automatic payment?". I said yes but by the time i got to be time for my bill on June 16 they interruptedmy service stating "my bill was past due". So i got it re-instated and they said "i would have to go down to the corporate office to pay my bill and change my billing date". The agent on the phone said they can change for me with no problems for free. So when I went to the corporateoffice in Chula vista, ca the girl i seen on June 23rd said I can get the billing date changed and she will do it at the moment. She asked what date i would like it changed to and said the 26 of every month because I received my phone and fully activated it on the 26 of April.

So the girl said okay and she claimed that she set up the new date. ThenI payed my bill only for June because I told them how I was supposed tobe set up as automatic payment through my credit card I used to order the service with. I told her if I check my credit card statement and I find I wasn't billed for May I will come and pay the remaining balance and she said that's fine. She told me I have until 7/1/10 to pay the remaining balance of $27.95 and the receipt said $27.66 was the remaining balance. Then on 7/1/10 I came back into the store to pay for May because my credit card statement showed I wasn't billed for that month. I was told I would have to pay $28.00 and $3 in-store payment fee.

I told him I shouldn't be charged for the $3 in-store payment fee because I payed it last time and a $10 late fee because I had to come here because of them not setting me up as Automatic payment in the firstplace. Also I questioned him as to why did my online account say that Iowe $71.00 when I tried to pay online today? And he said he doesn't know why. I told him that was another reason I had to come in today. I also mentioned that I was thinking I may have to get a class action lawsuit against them and he got very flustered, said if I feel that way he will not talk to me or give me service and will have to discontinue my service. He then walked away to a back room and had a conversation with someone via phone or in person for at least 5 minutes. He then cameback out and said do you want a lawsuit and I said I was only saying I was thinking it might be an option but I'm not saying I'm going to do it.

Then he said okay so are you going to pay the bill? So he said he will waive the $3 in-store payment this time and that from now on I can pay online and I said okay. So I payed him $28.00 and the receipt he gave me said my balance was $27.66 when I just payed the full balance that was remaining. He then checked the receipt and said supposedly it was due to their system updating. Then 7/3/10 I tried calling 1 800 cricket from my home phone and I spoke to a representative named "sheila" as she claimed. She had a terrible accent which made it very hard to understand her so I always had to repeat myself and repeat her question so I know we are on the same page. And she told me to go to thecorporate office to get my phone evaluated and she said the nearest office is at 645 st suite ef qula vista. I told her i googled it and nothing like that exists and she said mam that is the address.

So I looked up the address myself on the cricket website and it was actually 645 H st suite e-f Chula Vista, ca. I told her that and she said okay sorry about that mam is there anything else I can help you with?". I then asked if I can be transferred to an american because it's too much ahassle trying to figure out what each other is saying. And she said shecannot transfer and I would have to call back to speak with someone else. I told her online the Samsung u340 Refurb is free with the mail inrebate and will I be able to get it for free and she said yes I only have to pay the tax. So to clarify I asked if I will be charged at all and she said only for the tax. But it took us at least 3 minutes of repeating each other and asking each other the same questions did we finally get on the same page. Then I said okay thank you and she said bye.

Then I called back like 2-3 minutes later around 12 pm And spoke with another female and this time she claimed her name was Jill. But shesounded very similar to the other female I just got off the phone with. She was very difficult to understand with a harsh accent so I had to keep repeating myself and her questions. Then I asked her if I can speakwith an American because it's too hard to understand her. She said I would have to call back to speak with another agent. Then I told her that a previous agent told me that I can get the Samsung u340 for free with the mail in rebate offer. Then "Jill" said that I would have to payanother additional $15 activation fee for the phone. And I said the previous agent said if i already have service I dont have to pay the activation fee which she also said was one time fee only. And "Jill" kept insisting that I will be charged a fee for transferring my number or even getting a new phone activated.

So I said Can I speak with someone else and she said I'm not understanding and that the conversation is going no where so goodbye mam thank you for calling cricket and hung up on me. Also when I call the 1 800 cricket the So nowI am researching class action lawsuits against them so I can move forward to the next step. I am also trying to have them investigated with BBB and any other business complaint agencies. I am very displeasedwith their services and I hope they learn to correct their business practices while they have a chance before they get taken down with a class action law-suit. They also denied my mothers bill payment when itwas on her bank statement that cricket did in fact pull the funds from her account at least 5 times. They also made her physically go to a corporate store to show prof of the bank statements which was already intheir system.

Not only that they have charged her late fees every time and over charged her as well. Also another dirty little practice of theirs is if you pay online it doesn't get pulled until 24 hours after. So if you technically pay the bill on time cricket doesn't take the money out until 24 hours so you might end up being a day late. Please investigate cricket thoroughly and keep in contact with me. Please alsokeep my personal information confidential from cricket, crickets lawyersor representatives, and anyone else who may let cricket know.
