To the point:
We won a Digital Camera that never arrived and paid from our funds in our virtual Paypal Account (Big Mistake - Do not do it). The seller was (mail-direct) also known as Silicon Valley Imaging Corp who sent the camera to a wrong address, left it on front door and got lost. The carrier was fedEx. The seller refused to give us a refund or replacement until his claim with fedEx finishes. These dishonest people told us that in the event their claim got rejected by FedEx, they will not give us a refund to our account nor a replacement either.
We paid for Insurance so we asked for a replacement or our money back but they replied that the Insurance was: quote: "for damages during delivery only". Since the carrier was fedEx we asked them if that Insurance Policy was actually real and they said: quote: "that policy does not exist in our company". FedEx insures all shipment for up to $100 automaticaly. If the value is more than $100 and you do not declare the value, that is the maximum amount you will get from them. So yes! The item was insured automaticaly for damages or lost.
What happened next is that we opened a dispute against (mail-direct) / Silicon Valley Imaging Corp with Paypal to recover our payment. At the mean time (mail-direct) submitted a claim with FedEx that later was rejected due to (mail-direct)'s mistake. At this point was clear that they sent the item to the wrong address so they did not get the fedEx Insurance claim eventhough we paid the extra amount for them to insured our purchase.
What happened next is just Unbelievable... Paypal ruled to their favor under the Seller Protection Policy saying that because the seller provided us with a Tracking number, they will get our payment back into their account. Well, I also explained Paypal that it was up to them to refund that amount under the seller's protection policy but not from my money due to I never received any item. Also, I paid Insurance so I was protected in case of lost.
Well, we learned our lesson. Never use your Paypal or Checking account to pay for Ebay items sold by people with Negative Feedbacks. This seller is just using Ebay and Paypal and even the carriers to steal the buyers' money.
If there is somebody willing to file a legal claim or already did, please do contact me. I kept the FedEx report and letter sent to me as per my request, the item's description in which is shown that I paid for Insurance so I believe I can take them to court and get my money legal costs.
Beware of (mail-direct) / Silicon Valley Imaging Corp that sells crap online as you can see on its great amount of negative feedbacks.
