Fraudulent Billing MCI is charging me for a Cell phone I did not receive! Rip-off

In August of 1999 I purchased a Cell phone from MCI Wireless on a one year contract that I did not sign. All was agreed upon over the phone. Four days later my new phone arrived and I was pleased. August I was so happy with the service I received through MCI Wireless that I upgraded my plan for another year.in February my Cell phone was stolen from my home. I reported the loss to MCI and asked if they would disconnect the service so the phone could not be used. I still had a balance due on my account (which is another story) so my account was not closed at that time.

I asked if they would send me a replacement phone. The girl that was helping me was great, she faxed me a contract to sign, I returned it right back to her. She sent me an acknowledgment of receiving the contract informing me that my phone would be shipped in four to seven working days. I waited two weeks before calling MCI to let them know that I hadn't received my phone. They told me that the phone I had ordered was on back order.

I than selected a phone they had in stock. I waited another two weeks, and no phone. I then called their Customer Service Dept. (CSD) and they informed me, my phone had not been shipped, because they needed me to sign a contract!!! I told them at that time I had already signed a contract. I then asked them not to send me a phone. I want to pay off what I owe and will get a new phone at that time.in July I sent the final payment of what was outstanding on my account. I called their CSD to confirm my bill was paid in full and to be sure that my account was closed.

I had decided to go with a local wireless company, so I wasn't going to need the MCI phone after all.in August I received a letter from their accounts manager informing me that if I want to discontinue my service with MCI, I had to send them $200.00, other wise my account would remain open and I would be charged monthly for the contracted amount! I knew I had already fullfilled my previous contract with my original phone, so this letter did not make any since to me. I called the CSD and they could not access my records previous to March 16, which is the date I faxed back the contract that they said they didn't have.

They show no ship date for my phone, or record of any of our conversations. At present MCI has sent me to collection for $686.00. They just closed my account this past August for, your guessed it "NON-PAYMENT"! I asked who can I talk to to clear this matter, and I get an address. I wrote to the address, and a got a letter stating I have to pay. This has affected my TRW. The last time I spoke with a representative from MCI, they told me my account looks strange. My contract date is August 1999, but the beginning of the billing is March 16. Because I refuse to pay for a phone I didn't receive, I have been harrassed by MCI for the past year.
