Circuit City Protection Plan Refund scam, 4 months and still waiting for refund of my money

We purchased a 50 in. Vizio Plazma t.V. On 4/7/09. We had problems with it within the first couple of weeks. When we called Circuit City, they sent out a technician who a week later replaced the speakers on the t.V. Which were sent to us via Federal Express. This did not fix the problem. We called the Protection Plan folks again and was told that they would swap out the t.V. Because hey had problems getting parts for this t.V.

We were going to return the t.V. Anyway since we didn't think we should have a brand new t.V. Repaired. They did swap it out but we continued to have problems with the t.V. Eventually, we were told they would exchange it for another brand of our choice. On 9/26/07, we went to the Va. Beach store to select another t.V. This time we went with a Panasonic. Circuit City picked up the Vizio a few days later and delivered the new Panasonic. However, when we purchased the Panasonic we were told that we would have to purchase a new protection plan that they couldn't transfer it to the new t.V.

We were told we would get a refund on the cancelled plan. The manager at the store at at that time (Joe) said he would fax it to the department for a refund. We waited 4 weeks and did not receive a refund. I called the Circuit City Protection Plan Dept. And was told that they did not have a record of a cancelled plan for our ticket number.

I was told that they could take the info over the phone or I could do it online which would speed up the process. I chose to do it on line which I did that day at [email protected]. I received a response saying it would be processed within a few days. We waited another 3 or 4 weeks and I called again and was put on hold for over 40 minutes (this happened several times).

When I did finally speak with someone I was told she would expedite our refund. I waiting 2 weeks and called again. I was again put on hold for 45 minutes and I had to hang up because I couldn't wait any longer. I decided to submit a refund request in writing which I faxed to them on 12/4/07 as stated in their pre-recorded message. I also called again 7-10 days later and was told to go to the store where I made the purchase to speak with them directly which we did. The manager took down our info and said he would call us the next day. Still waiting for that call.

On 1/12/09, I went back to the store and spoke directly with the manager. Of course, it is now a new manager because Joe has been transferred. The new manager, Craig, took down my info and said he had a contact at the Protection Plan Dept. But they were closed on the weekend. He promised to call me on Monday. Still waiting for that call too. It has now been almost 4 months and we still have not received our refund. To sum it up, we have made numerous phone calls, several trips to the store as well as email and faxed a request for a refund. What do I have to do get my money?
