Ripoff dishonest deceptive no customer service claimed to refund for cancelled transaction but in reality did not

Purchased over the phone on 3/22/06 with Anthony a set of in-stock RBH 61-SE Cherry speakers for $799 with no shipping fees to be shipped that day. Credit card charged $855 and told would be credited for shipping fees when I called. Requested by e-mail confirmation of terms of sale & description of item purchased. No response received and no credit for shipping charges and no product.

Called Anthony on 4/02/06 & he advised that Cherry speakers were damaged so instead he had special ordered me black speakers. I pointed out I had not requested or authorized him to special order any item and that I wished to cancel the transaction & he said no problem it was cancelled & a credit would be issued to my credit card.

Received a call on 4/5/06 from Ray Dibi who identified himself as the owner stating he refused to cancel & would only consider it if I agreed to pay a 20% re-stocking fee. This sounds like extortion. I advised I would not pay any such fee as not only had I not ordered anything special or otherwise and they were in fact advertising the very item they claimed to have special ordered as IN STOCK on their web-site. I further told him that I had the terms & conditions of sales from their web-stie and there was no reference to any such re-stocking fee despite his claims to the contrary. When I asked him to direct me to exactly where these purported terms were he said he could no longer speak with me & had to get off the phone.

After speaking with Mr Dibi I realized that getting my money back was going to be a problem so I contacted RBH Speakers and the regional sales manager agreed to help me try to convince Mr. Dibi that he should credit my credit card as I had not special ordered anything nor received the (Cherry Speakers) that I thought I had purchased and that there was no re-stocking fees as Legacy carries the black speakers as IN STOCK items. He called Mr Dibi on 4/5/06 & suggested that in the manner of good customer service the cancellation that Anthony had given should be honored and my money should be refunded.

On 4/10/06 after first telling me that he had never spoken to me on 4/5/06 nor to the regional sales manager for RBH on that same date, Mr Dibi advised me by telephone that he had credited by credit card. On 4/13/06 Mr Dibi called me & provided an authorization number for the purported credit and then told me that I had no right to have filed a complaint aginst him with the Better Business Bureau. No such credit was processed & the authorization number turned out to be the original debit authorization number from 3/22/06. Mr Dibi and Legacy's conduct is dishonest at minimum and may be illegal as well. I do not belive it is legal to charge someone for a product that was not provided nor to honor a cancelation once granted nor to lie about processing a credit card refund and provide an authorization code that is not what it is purported to be.

From start to finish Legacy has not been truthful in their dealings with me and they have not credited my credit card despite their assurance that they did so. RBH has advised me that they are available to provide confirmation of the despicable way in which Mr Dibi and Legacy Audio & Video has conducted themselves.
