Trying to steal my house illegally

I would like to sue Household and am looking for a lawyer or to join a class action.

This is a letter to them outlining current status and their violations. Below that isa complaint I filed with Department of Corporations that goes into more detail.

All I am asking is for a fair resolution to this situation. You must realize I deserve that. I canft believe that you would take a home away from an innocent person. I have tried to be nice and I have been more than fair and I donft mean to make this into a war, I just canft sit by idly anymore.

As I have not heard from you and the foreclosure on my house is in approximately a week, I had no choice but to file formal complaints with Department of Corporations, Office of RESPA, State Attorney General, US Attorney General, Consumer Affairs.com, Department of Consumer Affairs, CA Department of Real Estate, Better Business Bureau, KCRA, The Union Newspaper, The Sacramento Bee, Seven on Your Side (Channel 7) and The complaint.

In these complaints I have described in great detail the series of illegal acts Household has committed over the past two years. I also included copies of all the documents to verify all your illegal acts.in addition, I have retained an attorney and will file a lawsuit if I do not receive a fair offer from you to resolve this matter by 4PM Wednesday August 27. Any communication must be faxed e-mailed.

To review your most flagrant RESPA violations;

You refused to respond to my written complaints for two years

You refused to offer a reasonable solution

You have refused to provide me with information

You conducted an illegal transfer of title

You have refused to put the house back into my name after you illegally transferred it out of my name

You are charging me interest on a loan that was according to your records, paid off, when you illegally transferred the title

If you have read my complaints, you know I am a key witness and the whistleblower against the Department of Mental Health for fraud and murder. This makes me a very hot topic in the press. I guarantee you that I can and will get the press to cover this if you continue to try and take the house away.

I am of course willing to dismiss all complaints against you if I am made a fair offer as all I really want is a fair resolution and to keep my home.

I pray that you will fax me or email me a fair offer.

As time is of the essence, this matter is urgent. I desperately need your help and would have written much earlier had I known of your existence sooner. I pray you will intervene and not allow the foreclosure pending to proceed. Mine is not the only story of its kind out there. If you look up Household on any number of consumer rights, better business, and/or rip off web sites, you will find a plethora of stories by people who are experiencing the same horrible, unethical and unfair treatment. So I hope you take my situation to heart and will help me because it might just serve many others as well by not only addressing my particular situation, but also uncovering and stopping the illegal activity causing the problems for hundreds or maybe thousands of families as well.

On January 10 I had owned my house for three years, worked as a mental health social worker at Department of Mental Health for four and half years. I had never paid late once on my house. I needed to refinance for a number of reasons, so I called the company that did my then existing home loan. The refinance was arranged through Pacific American Mortgage and Chuck Alimenia. I was sold a loan I could not afford with terms I did not agree to and charged fees I wasnt told about until the day of closing (please see complaint I filed against Pacific American Mortgage, copy attached). Then Pacifica American Mortgage sold my loan to Household Mortgage who was known at the time to be practicing illegal lending practices.

Later I had a major life change and it affected my ability to pay my mortgage. The story that follows details Households illegal practices that I have been victim of for the past two and a half years. Now they are trying to foreclose on me and the foreclosure will go through on unless you stop them

On January 10 a patient at our clinic who had been denied treatment, neglected by the treatment team, and abused by his doctor and a crisis worker, came to the office and killed two people.

I was unable to go back to work due to fear and I was in shock over what happened and went into a deep depression, but in April I became a whistleblower against my employer who was abusing mental health patients and stealing federal funds. Four hours after my testimony I lost my job. I had already been approved for workers compensation benefits but in retaliation they have refused to pay me any benefits.

When my temporary disability ran out in October, I knew it wouldn't be long before I couldn't make a house payment, so I called Household. I was told there was nothing they could do until I was three months late and to call back then. I surely did not want to do that since my credit would be ruined, but as many people I talked to and as many questions as I asked, that was the only option I was being offered. When my first payment was late, I received a letter threatening foreclosure.

I called again and was told that I could get a deferment and a reduced monthly payment. I sent them everything they required within a few days including a payment which I was told would stop any legal proceedings. I followed up with many phone calls. Nobody would return my calls and customer service just kept promising me I would get a deferrment and restructure and then would transfer me to voice mail.

I began to call and write and fax them to try and get someone's attention and assistance, but from that point on I couldn't get anyone to return my calls, letter or faxes. I did get another letter a few weeks later threatening foreclosure again. I called customer service and was told they would not accept a single payment and that I needed to pay the full balance past due. Then I got a call from Richard Martino indicating they never received my documents required for the deferment/reduction plan. I resent them immediately. Weeks went by before I heard anything and again I couldnt get anyone to return my communications.

Then I got a phone message indicating my deferment and restructure was approved deferring my arrears and reducing my payments to $650.00 a month. The message said I had to call him by the end of business that day. I called as soon as I got home and got the message but only got his voice mail as usual and never got a call back from him or anyone else.

A couple weeks later I got a letter saying my file was sent to the foreclosure department. I called Ed Quesada whose name was on the next foreclosure form letter I received several times. After a week, he called once. I returned his call, several times and received no response. Nearly a year went by and nobody would respond to any of my communications nor would they accept any payments.

In August I was approved for permanent Social Security Disability. This income combined with the income from my two rentals provides me with more than adequate income to pay my mortgage. I of course, made this information known to Household once again offering to resolve my delinquent account, but received no response. I called and spoke with several customer service people and finally thought to fax management to get some help since I was not allowed to ever talk with them.

After calling and faxing all the department heads in the company that I could get the names of and telling them what has been happening, I got a call from a Ken DeVane. I called and faxed him all my information he requested several times over a period of a couple weeks and finally he called and offered me a forbearance agreement. I signed the agreement, paid $3000 in arrears and made two payments in a row. Then the day after they cashed the last check my house title was illegally transferred out of my name. I was notified by a three day eviction notice on my door left by the realtor apparently hired to sell the house. I had not received notification as required by law. They had not communicated with me as required by law, they did not hold a foreclosure auction, they just simply took my money and disregarded the forbearance agreement.

I hired a lawyer and he was able to stop the eviction by way of speaking with the realtor, but nobody would call him back from Household. Unfortunately, my lawyer left the law firm and nobody bothered to tell me. When I found out, I chose not to continue with that law firm. I can't afford to pursue a law suit and have continued to fight this on my own. That was in November.

Since then, I have not been able to get anyone to return any of my calls, letter or faxes. I have attended a Consumer Credit Counseling/HUD Foreclosure Assistance Class, I followed all their guidelines. I submitted a hardship letter, a proposal with several alternatives on it, a written request for a response, my budget and all the verifying documentation. This isn't the first time I have submitted a similar package. I have been doing this over and over the past two years. This time, as with all the past times, nobody has responded to me.

On May 10, I got a letter saying I had two weeks to come up with $16,232.00 or they would foreclose. Then I received a letter stating I was being placed into foreclosure. The house is not in my name since they illegally foreclosed on it last year, so I don't know how they can foreclose again.

In the meantime, I filed complaints with several consumer advocacy groups and sent all of them to Household. Somehow the policy and compliance department got a hold of my complaint and called me. I was eventually offered the attached deal after lengthy negotiations. At first I thought is was a good deal, but came to realize they were just setting me up again. They are offering to waive 7 months of interest, but the loan was paid off by whoever has the "legal" title of my house and there has not been any outstanding loan or subsequent interest accruing, so I wouldn't think they could legally charge me interest on a loan that does not exist.

They offered to defer the remaining unpaid balance to the end of the loan, but require all my payments to be applied directly to the arrears until they are paid in full which means that I would instantly become behind again in my payments and accrue penalties and late fees and interest on the months going unpaid while I was paying the arrears. This would be a breach and I could be foreclosed on again.

In addition, Household refuses to provide me with a detail of the balance they say I owe, a description of the fees they are charging me or an explanation of over $2000.00 I paid yet has not been credited to my account. I wrote them a counter offer. I received a standard form letter back so they would be within RESPA guidelines. That was June 17 and I have yet to hear from them.

It is my belief they are waiting out the time for the foreclosure and then they will foreclose on me again. My credit is ruined, I am out thousands in lawyers fees and my house will be foreclosed on in early September which is a few weeks from now unless you intervene. They must not be allowed to get away with this. Please help me.
