My wife has just been garnished, 18 years after repossession of a car that was an absolute lemon. The Ford dealership was too incompetent to do proper repairs. She wasn't able to drive it, and did not understand the lemon law as she was young at the time. She allowed the car to be returned to Ford, and they sold it at auction, leaving a balance owed. She attempted to negotiate, but they didn't care. The last date on any document in the court docket was 1994 for a judgement. The S.O.L. Expired in and they failed to renew. June they filed a writ of garnishment in a different county and failed to file the writ with the original filing, which is required by law. They did reference the original court docket, but are not required to file a copy of original case in the new court. VERY DECEPTIVE!!!
We spoke to a lawyer, he called C. Heindel, atty for FMC, he stated he filed a "Nulla Bona". After double checking our files with the court clerks, the sheriff's and magistrates offices... No one has this so-called document. And it does have to be filed with the original filing. Another document they failed to actually file.
This is where the atty for FMC and FMC are in violation of law. We were informed that not only can we get the garnishment stopped, we can get our money back. And we can sue for damages. If anyone else has had this issue with Ford Motor Credit, let me know. Perhaps we can all help each other.
If they weren't so devious I wouldn't be placing this post. But they brought this on themselves. I will NEVER. EVER own a Ford EVER AGAIN. I will spread this story to anyone who is willing to hear, I guarantee it. FORD is a failing company and has been for sometime... I can certainly see why.
