Ripoff None Delivery Hidden Terms

I ordered a trial for $4.95. Later I got a charge on my account for $149.95. This charge caused me to investigate. When I called the number and figured out the company, I became upset because I had only authorized $4.95 and still had not received the trial sample, so why were they charging me $149.95.

When trying to reach someone in customer service, you were asked to leave a message because all the representative where busy. However, when I chose the telephone option as if I wanted to place an order, I was able to talk to a live person. Thus, he gave me a website in which to submit a "ticket. I submitted a ticket informing the company about the charge and me not receiving the first shipment.in response I kept getting a boiler plate response stating " you entered an agreement..." I responded that this boiler plate/form response was not applicable to my situation because I never received the trial offer, thus they failed to fulfil the condition precedent of the supposed contract because I never received the trial offer.

Finally, I received a real response in which it stated the date and time the trial was allegedly delivered. The $149.95 order was sent requiring a signature; thus, I am assuming the trial order was sent the same way. Therefore, I stated that they need to check the signatures because I did not sign for the trial package nor did I receive the trial sample.

In addition, I have stated I wanted to talk to a live person so that they can truly get the details. The response is to visit the online forum. I have gone to the forum several times and waited for about an hour for someone to acknowledge me, with no avail. I can not get anyone to provide customer service and speak to me.in dealing with other companies, I have always been able to speak to a live person. You may be on hold forever, but you eventually get to speak to someone. That is not an option with this company; something is fishy about that. Not to mention they keep sending the same boiler plate/form response.

More importantly, they are trying to bind people to a contract with out laying out the terms openly. The terms are hidden and not properly disclosed. If you are trying to bind someone to a contract, the terms should be laid out right before the signature line or submit button. When I went back to explore the website, to see where the terms they are referring to are located. First, a person must find the link and then click it to see what the terms and conditions are. If the terms are this harsh and are so costly, they should be right on the page for the consumer to read. Not hidden behind a hyperlink.

They say its the consumer's responsibility to read the term. It should also be their responsibility to disclose the terms in an open and obvious location/manner for the consumer to read and thus agree to. How many people would have ordered this product if the terms were openly disclosed - not many. I have never dealt with or heard of a free trial being conducting in this manner or binding you to some future obligation. I guess that is the price of dealing with reputable companies that care about their name being tarnished for a quick buck.

I never receive the trial offer and after how this company is handling everything, I do not want to deal with them.
