Kelly Wilson Real Estate Broker Rips Off Disabled Couple

My disabled husband and I feel we were ripped off and scammed by Kelly and Christy Wilson of United Country Wilson Realty in Ardmore Oklahoma.

I met Kelly Wilson, owner of United Country Realty, in April. He responded to a Craigslist ad I placed under the wanted section. The ad stated that my husband and I were looking for someone willing to owner finance us an RV to live in on a full time basis. My husband was 100% disabled which forced us to live on a very fixed income and that caused us to downsize everything. Our best solution seemed to be full time RV living which is much cheaper than home ownership.

The reason we chose to do business with Kelly Wilson was solely based on the fact the he was a Realtor and franchise owner of United Country Realty, a nationally recognized Agency. He and his wife were business owners and established in their community.

After responding to the many requests from individuals wanting to owner finance for us and speaking personally with Kelly Wilson and his wife Christy Wilson, we agreed on a down payment and monthly payments.initially, Kelly wanted us to quickly sign a contract and offered to deliver the RV for us right then and there on the spot. We had not yet found an RV park. We initially gave Kelly Wilson $500 with the agreement that we would pay the remainder of the the down payment and first months payment at the time of delivery. We did exactly that. Kelly delivered the RV and we signed a contract and then gave him the remaining $3000 for the deposit and $325 for first months payment.

We continued to make monthly payments until October. Kelly Wilson contacted me by phone on a Saturday late in the afternoon wanting to meet with me in person. I had no prior notice of this and my husband was in the hospital at the time as he had just undergone emergency surgery and was still in the Intensive Care Unit. I told Kelly that it was not a convenient time due to my husband's circumstances. I finally agreed to leave the hospital and meet with him at our home.

When we met, he promptly notified me that he had filed bankruptcy and needed to return our RV to the bank on Monday. I could not believe it. Kelly Wilson stated that he was not leaving without having possession of the RV. With my husband unable to help me make a decision or advice me on what to do... And with Kelly Wilson refusing to leave the RV Park without the RV, I felt I had no choice but to comply with his demands. I didn't have the title to the RV because it was not paid off and Kelly said that he was actually doing me a favor because the bank was going to repo it if he didn't have it back to them by Monday. He said they wouldn't even give me an opportunity to remove my contents first.

After begging and pleading with this man to at least give me time to find a storage unit the following day because it was now getting dark and I had nowhere to store anything. He again refused and said I needed to remove my things or he was taking them with the RV.

There was no reasoning with him. So until after midnight with the help of other RVer's in the park, all the contents were removed and just stacked on the RV pad. Everything was strewn about in haste to get it all out and I had no packing boxes and was unable to find a storage late on a Sat. Evening.

Kelly took the RV and left me sitting there with no home and my husband critically ill in the hospital. All this after we had payed him $3500 down and monthly payments for 17 months. He didn't even offer to refund the down payment. All he could say was, "I am sorry but the bank wants it returned on Monday and I have no choice but to give it to them."

So it appears that Kelly Wilson sold us property that he didn't actually own. Then to keep himself out of trouble with the bankruptcy court, he kicked us out of an RV that he sold us illegally to cover himself. I seriously doubt that he even paid any of the money to the bank where he had it financed. I don't know for sure because he lied to me when I ask him to give me the name of the bank where it was financed. On that Monday after he picked it up, government offices were opened and I was told by the Oklahoma Dept. Of Transportation that Oklahoma is a Tax Lien State and he could not legally sell me property that he had a lien on without first paying off the lien.

I know that in these hard economic times there are many creative financing options but I wouldn't recommend that anyone trust the word of a realtor without first consulting with a lawyer. Especially if that realtor is Kelly Wilson, franchise owner of United Country Wilson Realty in Ardmore, Oklahoma.
