Per our telephone conversation yesterday afternoon, we discussed only a few of these noted issues. After carefully reviewing the poor workmanship that has been done as well as the poor materials that were used by your contractors, here is a more in depth list of the deficiencies.
The following are items, material, and or labor that were done poorly or have faults now and for future failure.

1- Your contractors poured unmixed dry concrete directly from the bags into the holes they dug for the installation of all fence posts. No water was added during this process nor has the concrete stabilized any of the posts on either side of our property.

2- Finials (the day after installed) are cracking as these are square based attachments being stuck onto a triangular metal tip mount and the plastic is now stretched and turning light grey / white. A square piece of plastic does not fit onto a rectangular piece of metal without stretching and cracking.

3- All finials are different height across the top of the fence. Uneven and unsightly.

4- No finials installed along the side fences. Why not?

5- Single drop rod is not adequate to keep 8-foot long double gate from staying closed properly and securing the stability of the gate.

6- Side fence is of flimsy construction. It is not sturdy enough, and will not keep our dog in our yard. Just moving the fence slightly has already created a separation of fence and post in several areas. Several cross sections were not screwed in properly and have already become unattached. This fence was discussed at length with Dan, as he knew of the size and weight of our dog. (Doberman Pinscher who weighs about75 lbs now at only nine months of age, Dan assured us that this fence would be sturdy for the needs that have and it will keep our energetic dog in the back yard in a secure fashion.

7- The locks that your contractors installed can only be unlocked / locked (with a key) from one side. I was told that these would be usable from both sides of the gates, as they are installed right now, the only possible way to lock / unlock these gates is from only one side (the side that they are installed on).

8- None of the gates have a stop action on the bottom of any of the posts. The gates actually swing further than they should. This over time will create an issue with the straightness of the gate as well as the security of the gate staying on their hinges and staying in a closed position.

9- Hardware for the gates is not straight. Men working in the dark past 6 P.M. To finish quickly but work done sub standard.

10- The Fence along both separate driveways should be level and straight as both of our driveways are. There is no reason for this part of the fence to have any incline or decline. The fence in these areas is also of different height. Again this is a straight area that should have a straight & level fence.

11- The Fence should be properly secured to the house with a bracket attachment wherever there is a cross member. Workers used pieces of wood in the holes in the brick they drilled to fill gaps because they drilled holes too large for the screw size. Your contractors also used improper hardware such as sheet metal screws into our brick home. They did not use any anchors.

12- They defaced our home by drilling extra holes into house bricks for no apparent reason. So we now have extra unsightly holes for no apparent reason.

13- Concrete was poured in small 4 inch holes that your contractors drilled out for certain fence posts in both driveways. Unfortunately they poured way too much hydraulic concrete into these holes with lots of overages, so now these neat holes that were drilled look messy and have a poor appearance with lots of concreted poured onto our driveway.

14- Your crew left debris all over the place, lots of mud and hardware throughout project area that I cleaned up. Where holes were dug, nothing was backfilled. Many large boulders used by your installers left in holes. I guess they used these stones to tamp the dirt down, so this shows that they were un-prepared to do the job properly. I had to remove these small boulders and clean up after them.

15- I have documented this entire project with digital pictures of this poorly done installation. Please see the enclosed pictures I have attached

16- None of the fence sections line up. They are installed at different heights. The ground is level and there is no reason for the fence not to be level.

17- Some sections are already coming apart after just one day.

18- None of the posts are secured into the ground.
19- Several metal uprights have the metal separating front their joints.

20- Screws missing from hinges.

21- When one opens the gates (all) the gates scrape the concrete a few feet away.

22- All materials need to be removed. Due to the poor workmanship and materials used (not used) this contract is null and void.

I am giving you 3 business days from today's date (1/24/09) to remove all fence material (except posts that are in our concrete driveway. If any items, such as but not limited to irrigation lines or irrigation system, plants trees shrub's concrete, drainage pipes, lighting or lighting wiring, or utilities are damaged, I will hold your company responsible for the repair and or replacement of any such damage.

Please call me to schedule a time for your crew to come here and remove your material (except posts in our concrete driveways).

I will need to be home for this removal to take place.

If anyone comes on our property without me being home I will consider this as an act of tress passing and you or your workers will be subject to arrest. Act accordingly.
