Breaking Real Estate Laws - 4 Months to Receive Security Deposit - Terrible Place To Live

Hi,

My name is Jacob *. I was a resident of Waterford Village Apartments located in Durham, NC. I became a resident on October 2. I am contacting you because I moved out of this property on October 2nd, and am yet to receive any written notification regarding my security deposit. I have contacted the property managers office on several occasions, and was assured that a check was on its way. I'm now being told that the company has undergone multiple staff changes over the holidays, and they just haven't gotten to it. I have been under the impression that North Carolina law governing a real estate deposit requires that the landlord provide a written statement of the deposit, and any balance due within 30 days. I had a real estate license in Georgia, and I know the mis-handling of security deposits is quite an offense.

Additional Notes about my stay at the property.
—I lived in the apartment from October 2 until March when I moved due to job relocation. (I have pictures)
—I was not allowed out of my lease. During that 5 month span:
—The property because infested with ants on 2 separate occasions, which the property manages described as a seasonal problem.
—The property flooded on 3 separate occasions, warranting the contracting of an extraction company.
—They hooked up dehumidifiers and extraction equipment using my water and electricity. I was not reimbursed.
—I was informed I could get someone to take over my lease... Is searched for 3 months (while continuing to pay rent).
—I found several tenants, but they would not move into the apartment because it smelled like mold, and the baseboards were beginning to rot because it had flooded on so many occasions.
—I advised the property manager that I could not even rent the apartment out because it was not fit to live in. (I have pictures)
—They replaced all of the baseboards and some drywall, and repainted over the course of several weeks.
—They also ruined my vacuum cleaner by using it to clean up their drywall mess.
—I was able to place a friend into the apartment for the duration of my lease.
—We moved out on October 2nd. The apartment was in great condition. (I have pictures)
—In the beginning of December, I contacted the property managers office to inquire about my Security Deposit. I was informed there were no problems and that I should be able to receive it before Christmas.
—In the later part of December (pre-Christmas) I contacted the office and was informed they no longer have a property manager, but I would receive a call from someone.
—I never received a call from anyone, and in the beginning of January contacted them again... I was informed that the security deposit would be less a water bill that I apparently owed (the property bills you for water, and I never received a copy of this bill).
—January 21, I still have not received a check and I contact, threatening to hire a lawyer if this is not quickly resolved.inform them that I am aware of NC law regarding security deposits.
—January 26, I contact you requesting assistance.
