CDC contracted for major home improvements and additions on 8/07 with a 10K deposit.
— Did not begin work until 4/4/08.
— Fired 10/08 due to unsatifactory contract completion, in addition they were claiming bankruptcy.

Dear Sal and Bruce,

Here are the items we discussed today, September 30 between 8:30am and 10:00am with Sal at our residence and with Bruce at 1:30pm via Sal's cell phone

We need a written schedule of work from CDC by Thursday, October 2 outlining each day's work plan. We have asked for a work schedule numerous times, we had previously requested one prior, in writing, on July 17; we have yet to receive any written schedule to date.

Items outstanding from our letter sent to you on July 17

Interior joints on new block above and behind electrical panel are to be filled properly. All interior joints to be shaped with S tool. A bead of cement is to be piped into the joint between new block and new sill plate (From corner near electrical panel towards stairs) (note on September 30 To date this has not been completed)

Breezeway steps Please provide this information in the written timeline with Start / finish dates (JB note on September 30 The stairs need to be installed towards end of job to allow excavator access to backyard). This item subcontracted by homeowner - CDC did not complete.

Items discussed with Sal this morning, September 30:

To date the garage floor has not been poured. CDC has stated they wish to wait so as not to damage floor. Homeowner understands CDC's position; however we now are requesting the floor be poured ASAP. Please provide the date when this will be installed as preparation of current base needs to be addressed for future floor needs (re-bar, etc.). This item subcontracted by homeowner - CDC did not complete.

Front door picked out by homeowner is approximately $2,500.00. Homeowner needs to provide decision on extra costs. Please provide lead time to homeowner for door delivery if door picked out is ordered. This item subcontracted by homeowner - CDC did not complete or purchase.

Rear roof leaked during rains on September 26 28th. CDC is to investigate and make corrections immediately to roof. As of 1/23, roof is still leaking.

One complete copper roof covering is needed to determine whether homeowner will continue with installing copper roof on all dormer roofs and portico. We have asked for one dormer to be installed with the cooper and another with Grandslate shingles so a decision can be made. We have asked for this for over 2 months this must become a priority. Never received from CDC. This item subcontracted by homeowner - CDC did not complete.

Sliding patio door off of kitchen Homeowner has found a door at Pella that meets their requirements. Specification sheet is attached. Please provide pricing ASAP so a decision can be made. This item subcontracted by homeowner - CDC did not complete.

Shale that was brought in from off site by CDC and used as fill in front of house from basement window to front porch is to be completely removed and replaced with clean fill. Water has penetrated the newly rebuilt, parged and tarred masonry wall installed by CDC each time it rains. This is not a negotiable request we also request that either the homeowner or their designee be present when the new clean fill is installed and properly compacted at every foot of elevation. CDC did not complete.

Homeowner has stated their displeasure with fill material in front porch. Although there is a large volume of slate material form the roof of the home, the hole is filled with miscellaneous refuse and building materials. Homeowner requests removal of all material; however homeowner's mason contractor will be consulted to see if the slate can stay in the hole as long as it is compacted somewhat and filled in with fresh fill, compacted at every foot elevation. CDC did not complete.

Steel beam in great room columns have not been welded in place. This is to be done ASAP; beam has been installed for over 3 weeks. This item subcontracted by homeowner - CDC did not complete.

Garage door selection is to begin immediately. Please make arrangements with your garage door vendor to meet with homeowner ASAP so selections can be made. Meetings with homeowners can only take place after 6pm weekdays or on weekends. This item subcontracted by homeowner - CDC did not complete.

Steel Column and concrete footing in basement has yet to be installed. This is to be done ASAP. We have brought this to your attention numerous times. This item subcontracted by homeowner - CDC did not complete.

Sal stated that the rear property was graded to his preliminary satisfaction. Although homeowner does not completely agree, it was decided that CDC was to removal all concrete debris and remnants in rear property ASAP.

Front of property is to be properly cleaned of all debris, piles, refuse and leveled / graded to homeowners satisfaction.

Items currently outstanding but not discussed with Sal on September 30

We would like to know when the bilco door will be installed to secure the basement properly. This item subcontracted by homeowner - CDC did not complete.

Floor in new addition is not level with existing floor. Please make arrangements to install a thin ply material to bring this floor up to proper level. This item subcontracted by homeowner - CDC did not complete.

Sal stated during the meeting on September 30 that Patrick, the sheathing, roofing, siding sub contractor, was running late and would be on site shortly. At 11:30am, no one was on site; calls were made at 12:30pm and 1:30pm to Sal's cell phone. A message was left at 12:30pm; at 1:30pm, Bruce answered Sal's phone and stated that Patrick would not be on site and that there is really no a lot for him to do about a half a day at most and since the windows were not in, Patrick really couldn't go any further. As it abundantly clear above, this is not the case there are many, many open items that need to be addressed; some outstanding for over 3 months.

It was relayed to Bruce that based on a lack of production on the job (no work has been done since Tuesday afternoon, September 23rd; as well as numerous days in September and nearly all of the last 3 weeks of the month of August) that if the windows, which have been stated by Sal to be delivered on Thursday, October 2nd, are not installed on Friday, October 3rd (weather permitting if it rains on Friday, October 3rd, we expect a crew here on Saturday, October 4th), then CDC will be terminated as contractor. We have been more than patient with CDC up to this point. We will no longer tolerate any more delays.

It is absolutely astonishing that 6 months to the day ground was broken and this project started that we are not even at the point of window installation. CDC has had months to order windows, yet now the job grinds to a halt because they are not on site. It is delays such as this, along with CDC's view that there really isn't much more to do so their sub contractor will just wait until there is more to do that has forced our hand and brought us to this ultimatum.

I expect a written job schedule addressing all of the above items, along with the remaining items not address in this letter on Thursday, October 2.
