I moved out of an apartment, located in Utica, NY owned by this company (based in NYC) on May 5. After about 3 weeks (and several phone calls), I contacted the property manager, Chris Sickler, about my security deposit. He claimed that he would contact the office and that I would receive my deposit back soon.
Another week passes and I still don't receive my deposit. I tried contacting Mr. Sickler several times and I only reached him after leaving a message threatening to take matters to court. He informed me that he had contacted the office and still wasn't sure as to why I hadn't received my deposit. I then asked him for the offices contact number which he REFUSED to give to me. All he gave me was the PO box which I had previously mailed my rent to on one occasion.
I have since sent a certified letter to this address and the letter has yet to be picked up since its delivery on July 13.in the letter, I explained that if I didn't receive my deposit back in a timely manner that I would take them to court, as well as report them to several online sites.
I spoke with a representative of the Utica City Court and unfortunately I can't file a civil claim in Utica since the company is based in New York City. So I have to find a way to file this in NYC. The downside is that it is about a 5 hour ride from here in Rochester to New York.
If anyone has any advice, it would be greatly appreciated.
