On June 5, I entered into a contract with Destiny Manufactured Home of Manteca, for the installation of a small manufactured home on my lot. The Salesman, Mr. Lee Brittell required $80,000.00 cash to be place in an escrow account with Alliance Title in Modesto, California.

I was deceived, in that the salesman, Lee Brittell had me sign several release of funds prior to escrow papers. The funds were released the very next day totaling $9,700.00.

On July 9, funds were release in the amount of $20,000. Months latter I was presented with outrageous escrow instructions, with language such as: "Vesting to be determined from Designation of Co-Owner Term as submitted to Dealer herein." I am a single woman. Who would qualify to be my co-owner? And who empowered the Dealer to make such a designation?

The Escrow Instructions do not mention: Any of the factory options, the sidewalk, the driveway, the garage, set-up and installation, etc.

This house would have been simply dumped on my lot and the funds would have been fully paid out of the escrow account had I signed the escrow instructions.

Alliance Title did not state their role in this mess until several months later and well after funds totaling, $30,000.00 were spent.

Their role would be depositor only according to the unsigned escrow instructions.

Attempts were made to force me to sign escrow papers that only stated the manufactured home would be delivered and not installed.

plainly did not include a foundation for this manufactured home. Two set of escrow instruction and neither had a glossary of terms. Attempts were made to force me to sign additional worksheets that would raise the contracted price. Because I would not agree to this escrow rape, funds totally $30,000.00 have been spent, the remaining $50,000.00 remains in escrow for several years, now.

This company does not have a contractors license and has
been given a warning by the State Contractors Board.

According the the Department of Corporations, Destiny
Manufactured Homes was contracting outside of their
licensed field.

This company signed a certificate of compliance with Stockton Unified School District for the erection of a residential building and yet, they possess no contractors license

This company professed to have exerience in building in the City of Stockton, California. According to the business license division Destiny Manufactured Homes took out a business license using another contractors license.

The foundation was place in the wrong spot. The foundation price quoted and signed for was $2,100.00. The actually, price is $8,000.00 to $10,000.00, according to the subcontractor. The bait and switch list goes on and on.

None of the items I had paid for were included in the Escrow Instructions and that is why the escrow instructions remain unsigned to this day.

The Department of Housing and Community Development, Manufactured Housing Division have fined this company $500.00. And have not required Destiny Manufactured Homes to return any of the funds, even though they were cited by the Contractors Board for contracting without a license.

The Department of Housing have simply stated that this company has neglected to put the name of the contractor on the contract.

Stockton Unified School District posses a cancelled check from Destiny Manufactured homes in the amount of $3,920.40, for the erection of a residential building, 891 square footage.

A real estate broker was never used in this real estate tranaction. The California Department of Real Estate states that a broker was necessary for this type of transaction.

This company has attempted to produce several 14 X 66 buildings. The first was a two bedroom, one bath. I ordered a three bedroom, two bath. It disappeared and nobody knows what happened to it, including the Department of Housing and Community Development.

However, an add was placed in the Pennysaver in the second quarter of for the sale of the first manufactured home.

A second home was produced with two bathrooms in the hallway like a department store. It too was rejected by me.

I had waited long enough for the corrected escrow instructions and a correct manufactured home. Even the plans on record at the City of Stockton are not the plans approved by me.

This has been a nightmare, including the physical harrassment of my residence, car and phone number.

Two years and 7 months have passed and neither Alliance Title of Modesto, CA nor Destiny Manufactured Homes of Manteca, CA, have refunded the money fraudulently taken from this widow.

Proof of fraud has been provided to all agencies involved. Yet, not one including the Better Business Bureau, the Department of Housing, the Contractors Board, the Department of Corporations, the Department of Insurance, the City of Stockton, CA, the District Attorney's Office and the San Joaquin County Superior Court has required this company to pay back this widow for it obvious bait and switch and escrow fraud.

I did not receive the house and I have not received a refund of the money placed in escrow. What a corrupt system we live in! Certainly, in need of change.
