Received broken item. Not returning money 352.52

Once the shipping company delivered the item, we inspected it prior to the delivery company leaving our home. Upon our inspection, we noticed that one of the iron legs were broken off, the corner of the broken off marble top was not included as stated in the ad as it would be.

In empire liquidator's ad it states This listing contains the following: Everything that you see in the photos above and below as well as the description to the left".

The photos above showed a mirror and a faucet. These items were not included as we were led to believe. We did not accept the item and it was sent back. We immediately got on the phone with Empire Liquidators and spoke with a young lady by the name of Dawn. We explained to her the reason for our return and what our findings were.

We were told that they had to file a claim with their shipping company before we could get our money back (352.50). We can not seem to understand why we have to wait until they are paid before we are paid. When in fact we did not purchase the item from the shipping company, we purchased it from them (Empire Liquidators).

Furthermore, Empire Liquidators keeps changing their story. First they told us that the ad stood as it was and that we misread it. Two weeks later, we spoke with Dawn and she stated there was a faucet but the shipping company lost it. Now the story has changed from us misreading the ad to the shipping company lost it.
We received an email stating for us to to speak with Chris (Supervisor over refunds). Spoke with Chris on November 11th. Was told by him we needed to speak with Dawn. We spoke with Dawn on the same day 11th, and she stated that they had heard nothing back from the shipping company. Again, what does this have to do with us? Spoke with!

Called again and spoke with Dawn and she stated that the shipping company told her that the paperwork was in the claims department. I asked her Do we have to wait until you get paid. She said yes. I also asked her if you don't get paid, we don't get our money back, she again stated yes. We exercised a great deal of patience and attempting to resolve this matter to get our money back. However, we feel we are getting the runaround. It's been over a month now and now we are requesting your help in this matter.
