Breach of contract, non-payment, fraud, bankruptcy

Before doing business with Scot William Lightbody, please consider the following information, much of which is public record, and can be verified through various resources available online or at the Dupage County complex located in Wheaton, IL. This information was also obtained through interviews with subcontractors, suppliers, and homeowners.

Scot W. Lightbody is the president of Trison Builders Inc, Glen Ellyn, IL, and there is a relationship between Trison Builders Inc and Ivco Inc. Ivco was owned by Scot Lightbody's father, William Lightbody, who died in May. Scot serves as secretary for Ivco, his father served as secretary for Trison, and the companies are affiliates of one another. Scot Lightbody has also done business in Illinois as Trison Realty, Trison Development Corporation (which was involuntarily dissolved in June), and a new company named Paramount Homebuilders.

Trison Builders Inc. And Ivco Inc closed on five homes that sold for approximately $500,000 each in the first half of 2005.

During 2004 - 2005 Scot Lightbody failed to pay numerous subcontractors and suppliers contracted by both Trison Builders and Ivco. Somehow this fact eluded the title companies, and the title companies allowed several Trison Builder and Ivco homeowners to close on their properties. Consequently, several subcontractors filed mechanics liens against these homeowner's properties, which in some cases exceed tens of thousands of dollars. At the same time, many subcontractors and suppliers did not file liens, and are now facing losses that range from $150 to over $20,000.

In April Trison Builders failed to pay a realtor's commission for the sale of a new home.

As of September Trison Builders and Ivco have failed to pay the 2004 property taxes for several properties sold in forcing the homeowners to pay the property taxes or face a tax sale of their property from the county. Trison Builders did not complete the punch lists or warranty repairs for several properties, leaving homeowners with thousands of dollars in repair costs.

Trison Builders filed for bankruptcy in July. A copy of Trison Builder's bankruptcy petition is available from the United States Bankruptcy Court for the Northern District of Illinois. The names of the subcontractors, suppliers, realtor, and the Dupage County Collector (for non-payment of property taxes) can be found in the document, along with the amount owed to each of these creditors.

Trison Builders and Ivco have been involved in numerous lawsuits for breach of contract, lien issues, and permit violations stretching back several years. These lawsuits can be viewed at the Dupage County court building.
