Court case: E-Z Movers, Inc. v. Rowell (2016)

E-Z Movers, Inc. v. Rowell (Appellate Court of Illinois, First District, No. 1-15-0435; 2016 IL App (1st) 150435, decided August 2, 2016) was a dispute over unemployment insurance, not a case brought by a customer. In 2009, after one of the company's workers applied for unemployment insurance benefits, the Illinois Department of Employment Security learned that E-Z Movers had not reported those workers' wages to it, and the Department audited E-Z Movers for 2007 and 2008, then issued an assessment of $25,014.70 in unemployment insurance contributions. The Department determined that E-Z Movers had not shown that its drivers and helpers qualified for the exemptions from "employment" set out in section 212 of the Illinois Unemployment Insurance Act. A circuit court had reversed the Department's decision, but the appellate court reversed the circuit court and affirmed the Department, ruling in the Department's favor on how those workers should be classified for unemployment insurance purposes.
