Dishonest trade practices towards claim for hail damage.
RE: Hail claim 09/15/03 2002 Ford Explorer Sport with Progressive Insurance
Spoke to Jamie Cano, Scott Jergensen & Julie Wadley of Progressive Insurance
Check was issued for $1612.70. Took to several shops and it can't be repaired for that amount.
On 06/07/04 I sent certified letter to Jamie Cano that we are in dispute and I have obtained an appraiser James Walden to invoke my right to demand appraisal. Also requested to know name and phone number of who was going to represent Progressive in the appraisal process. Jamie Cano stated received certified letter. He was aware of the appraisal process with a 3rd party umpire and there would be no problem participating in the appraisal process. 2 weeks later Jamie Cano was out for extended time for disaster in Florida.
Claim was referred to Scott Jergensen. I stated again, I need to know name and phone number of the appraiser. Faxed another copy of the letter I sent regarding obtaining James Walden as appraiser. Told Scott Jergensen that James Walden was representing me and he could talk to him. Scott said letter had been sent to me regarding their position relative to appraisal request.
If James Walden is serving as representative on this claim if in fact that is the case need to get a letter of representation from him so that they can communicate directly with him regarding this. He gave me Progressive' address and he would probably be out of office but could talk to his boss Julie Wadley at 972-643-6270.
At that time Scott said not in dispute. The appraisal part did not apply. Mr. Walden needs to send letter of representation. They have to have letter. He has to identify himself as well. Can't just take the letter I signed and sent certified. Have to have letter from James Walden too. Then they would no longer speak to me but to him. Not in dispute. Don't know what damages or what additional costs estimates are. Progressive not disputing. They wrote estimate. I kept asking for appraiser name and phone number. They kept telling me we are not in dispute. We are not to the appraisal process yet.
Claim was referred to Julie Wadley. Spoke to 3 people now. Car still not repaired. Took to several shops can't fix for that amount. We were told we could hire independent appraiser. We did that. We sent certified letter to Progressive advising James Walden's name and number. Need to know if you are going to participate in the appraisal process. If so who is the appraiser and his phone number. If not why?
Julie Wadley said that they had not said they would not pay more on the claim. They issue supplemental payments every day. She stated that I had not taken my car to a shop. Any shop or a Progressive preferred shop so they can work with the shop. If they can't come to agreement if the shop says pay it this way & company says no. The appraisal comes into play. Haven't had dispute yet. Haven't gotten that far since I haven't taken my car to shop. This is her problem every shop refuses to deal with Progressive.
She said they knew who James Walden was. They have dealt with him several times on several claims but they don't talk to him. Julie Wadley Said we must take it to a body shop and let them know where it is or take it to a progressive Body shop. I refuse tyo not be able to pick my own shop. I have the right to choose my own shop. Body Shop refuses to deal with progressive on disputed claim. States same as all other shops have over the past year. I need to hire professional appraiser. I am stuck in the middle. Please have Julie Wadley deal directly with the professional Appraiser hired by me.
