This is the summation of facts that I specifically included against John J Farland in a 30 day demand letter for my money. This is basically what happened, and will be included in the small claims lawsuit against him. So when it says below "I won an auction you listed" I am talking to John himself, so you know who I am referring to when I say "you" below.
"On or about September 18 I won an auction you listed on ebay for a 1990 xj6 Sovereign Jaguar, white in color. The exact listing stated the following: Engine... Runs good with no problems at all. Transmission... No problems with the transmission at allUnder side... Rust and rot free. Not rot on this car at allLeaks... No leaks noise or smoke coming from this vehicle. Sound System... Great sounding radioDrive it away... You can drive this car away but it will need front tires
Moreover, before the listing ended I placed a telephone call to you in person while you were at the Museum of Science here in Boston in which you stated there was nothing wrong with the vehicle and the ebay listing had all the information, and it was correct.
Accordingly, after the auction ended I immediately sent $500 dollars through Paypal to cover the mandatory deposit. Furthermore, my wife and I came down on or about the 22nd of September with a cashier's check made out for One Thousand Five Hundred Dollars and zero cents from East Boston Savings Bank. The price for the car totaled $2000. The check for $1500 plus the deposit through Paypal of $500.
At this time I also explained to you this car was specifically being purchased as a gift for a man who at 28 years old did not have a vehicle, lost his mother over a year ago, lost his dad when he was very young, graduated from seminary and did not have the money to purchase a vehicle for himself. Immediately upon starting the vehicle the belts squealed and never stopped. Furthermore the car lagged refusing to accelerate correctly even backfiring at times; after I personally drove the car approximately two to three miles the car lost all power and would not move. At this time I called you and you came to tow the vehicle back to your car lot. You explained you would fix the problem and promised to deliver the vehicle to Chris on Sunday, possibly Monday. (September 21-22), who resided at 49 Roseland St. Cambridge, MA, because of the long distance it took for us to pick up the vehicle. After this time period expired I called you again and again to retrieve the vehicle, this went on for weeks without you delivering the vehicle to either Chris or myself. Finally I again personally drove to your dealership on October 14 with a friend when I perceived you were trying to allow the 30 day warranty period to lapse.
You assured me the problem was fixed, and there were no longer any problems with the car. I again noticed the same problems with the car within one mile after leaving the dealership, and upon driving the vehicle approximately 3-4 miles the car lost all power on I-90 East heading toward Boston, and broke down. This was at a time where there was a lot of traffic and put me in danger of being hit by traffic as I moved to the side of the road. I called you on the telephone and asked that you come and tow the vehicle. You explained that it was Friday and you had better things to do, and could not come and tow the vehicle. I explained to you I had no way of towing the vehicle and had no connections to towing agencies for your area. You got upset and told me I ran the car low on gas, even though it had half a tank.
I specifically explained to you that I was leaving the car beside I-90 and that you would have to come and pick up the vehicle. Subsequently the vehicle was towed by the Massachusetts State Police and taken to an impound lot. You refused to give me my money back, unless I brought you the vehicle. On Tuesday, the 17th of October, I went to the impound lot with the same dealer plate to tow the vehicle back. At this time Gary the owner of the impound lot informed me you were picking up the vehicle in the afternoon, and I did not need to tow the vehicle back to you. I left the ignition key with Gary at that time and two days later I was informed by Gary you still had not picked up the vehicle as promised."
