If you had a bad deal with this dealership, I urge you to file a complaint with the Attorney General. I may not be able to do much as one person, but if several people file their complaints, the state may be able to do something about their fradulent operation. See my complaint below:

I went into North Texas Nissan to buy 2007 Maxima on 07/28. I drove the car and then the negotiation process started. Trading in a vehicle and with $4000 down, I told them I did not want my payments over $500 a month and I only wanted to finance for 5 years. So I signed a little note that said if the price is $500 @ month I would take the vehicle that evening. They came back with a monthly payment of $560-$580, which I told them was too high. But the salesman, Andy White talked me into $525... Again the same procedure with the note (but I said that I had to authorize that amount with my husband). They came back quickly and said that it was a deal. I told him that I need specific information... I needed to know how much they were giving me for my trade, what was the interest rate, how much was I financing, etc.

My salesman said no problem, when you get into the finance department to do your paperwork, they will have all of that information for you. I said that I needed this information, before I could agree to a deal. He said that he did not have any of that information, but the finance specialist who would execute my paperwork would have all of that information. So I waited about 30 minutes and finally got to speak with this financial specialist.

They put me in his office and told me that everything was going to be video taped. I told him before I could purchase this car, I needed to call my husband and give him the details. He told me that they were giving me the exact payoff for my trade and with $4000 down my payment would be $525 @ month.

I called my husband and explained over the phone, but he had questions, so I turned my cell phone over to Sean Briggs the finance specialist. After asking questions, my husband realized that this was not a 60 month note, it was for 72 months. So my husband hung up. I was leaving and they asked me what it would take for me to buy the car that night. I told Sean Briggs and Andy White that my payments had to be $500 @ 60 months. He came back almost immediately and said it was a deal.

I called my husband back and he spoke to Sean Briggs again. And he told my husband that they called Nissan and were able to get the interest rate from 10.99% down to 6.99% and with other discounts, they were able to make my payments $500 per month for 60 months (this was about 10 PM on a Friday night). He also talked me into an extended warranty for $13 more per month. He went over the paperwork very quickly.

He went over this long yellow sheet with all the numbers on it (I thought was my contract); looking at this paper now, at the top it says motor vehicle purchase order.

12 days after the transaction, August 9th, I received a letter in the mail from Nissan Acceptance Corporation, welcoming me to my lease. It had the lease terms at the top of this letter: 60 month lease, 12,000 per year limit, $513 monthly payment. I called Nissan and explained that there must have been a mistake. I was told there was not mistake, that the dealership had processed this as a lease.

I called the dealership and spoke with the finance manager, Sean Hodges. He told me that there was no mistake, that this was a lease and that I knew it. I told him that he was wrong and I did not lease the vehicleI purchased it. I told him none of my paperwork has any kind of lease agreements. He explained the contract color and sizeand I did not have it. They did not give me a copy at the time of signing. They assured me that I left with a copy the night the transaction took place. We went back and forth and he finally told me that I should speak to the person who executed my paperwork. He was off that day and would be in the next day @ 11 AM.

I called the next day and got the same run around, I spoke to my salesman, Andy White and the finance specialist, Sean Briggs that executed my paperwork and this was the quote out of both of their mouths. Yes ma'am, you knew this was a lease. I told the finance person that I did not want the car as a lease I wanted it as a purchase. He said he could convert it over to a purchase, but my payments would go up considerably. I told him that would not work. I argued, but knew I was getting nowhere. I asked for a copy of the signed lease agreement, since I did not have a copy of what I had agreed to. He told me they were going to mail it overnight and that I would have it the next day at 10 AM, Friday (2 weeks after the transaction).

My husband also called and spoke to the Sean Briggs and he assures my husband that I left there that night with a copy of the lease agreement. Which I did not leave with it, I left with what I thought was my contract. The motor vehicle purchase order. I did not receive the contract the next day like they said I would, so I drove 1 hours to the dealership on Saturday for them to tell me that all contract are locked in a vault upstairs, could I come back Monday.

I then spoke to the floor manager and explained our problem. So he sat me and my husband down and explained the lease to us. I told him this was the first time that I have heard these terms, other that what I read in the acceptance letter I received (which was after the transaction). All he could do was apologize and he gave us a gas ticket for the gas we spent driving there. It took me 5 days to get a copy of this contract.

I have called and spoke to Nissan (who I would make the payments to); I have talked to the consumer affairs department, collections, customer service and I am getting nowhere.

We finally got the lease agreement Monday, August 14th. And I again called the dealership and talked to the Sean Hodges, finance manager, telling him that I just received the lease agreement papers and I tried to explain how I was unaware that this was a lease and no one even mentioned the word lease and that I was under the impression that this was a purchase. He said that they told me that this was a residual based finance. And I told him that I guess I did not know what a residual based finance was. It is a lease.

I asked him if there was an interest rate on a lease and he said there was a money factor, it wasn't really an interest rate, but could be converted to one. I was told during the negotiation process that this loan had an interest rate of 10.99% and was being lowered to 6.99%. Everyone that I dealt with at this dealership was very deceptive and lied straight to my face. The paperwork was done at 10:30 PM, so they had an advantage of wearing me down. I asked them several times if I could come back in the morning to finish the transaction and they kept pushing. I did sign the paperwork, taking their word on what I was signing, but it was 2 and weeks after the sale before I received a copy of the lease agreement.

I turned the car back in 3 weeks after the signing of the contract.
