Lexus GX 460 Recall

On 4/9 took out a 3 year lease with a $15,000 cash down payment on a 2010 Lexus GX 460. Several days later "Consumer Reports" published a report recommending a "Don't Buy" on this specific vehicle due to problems with potential roll-overs/traction. Given that I had just leased the vehicle days before this report (and Lexus' acknowledgment of the problem) I returned the car to the dealership and have asked that the contract be rescinded and my money returned. The car only has 100 miles on it. Lexus is working on a "software" fix for the defect. However, this car is meant for my wife and young kids and my wife understandably refuses to drive the car — even with a supposed "fix." I have emailed Lexus of Pleasanton's General Manager (Bob Slap) and have had one in-person meeting and several phone conversations with Lexus of Pleasanton's Operations Manager (John Cabral). The original sales person was Eric Hansen. They will not take the car back and rescind the contract despite the admission that there is a serious engineering flaw. They state that regardless of what Lexus International/Toyota has said they locally would lose money if they do that. They have offered to take back the defective GX only if I lease a much more expensive LX 570 for full MSRP at $85,000. They feel I should pay full MSRP (and thereby double my lease payment) since they would be doing me a favor to take back the defective GX.
