USAA, USA Autogroup, USAA Insurance, United Services Auto Association USAA violates settlement agreements

January 4, Ms. Sheena Reuther backed her mother's (Lisa Dunning's) Ford Escort into my Celica. She left her place of work, walked past my car in a line of stationary vehicles, got into her car, started it, and backed into my car hard enough to push my heavier vehicle several feet to the right.

After negotiations with USAA only resulted in rude and unprofessional treatment by the USAA agent working on the case, followed by a letter in which USAA threatened to steal my vehicle if I did not turn it over to them, and to charge me for storage, even though they were not storing the vehicle, and a joke of an offer which would not even begin to replace or repair the vehicle, I went to an attorney.

With the attorney's assistance, we worked out a settlement agreement with USAA. USAA aggreed to pay a portion of their estimate of repairs and agreed that even at the full cost of repairs, the vehicle was not a total loss.

I received a payment from USAA a couple weeks later, but the payment stated that it was full and final payment for all damages and losses related to the total loss of my vehicle.

I destroyed a portion of the check and returned the remainder to USAA with a letter stating that the payment was not in line with the settlement agreement.

USAA ignored this letter.

I gave them plenty of time to respond, then sent a second letter, informing them that if they did not provide payment in line with the settlement agreement within twenty days, that I was given no choce but to take their client to court as the uninsured motorist she obviously is.

I promptly received a corrected payment.

Fast forward to 2009.in the process of moving earlier this year, I had to change the registration address on my vehicles. During this process, I learned that there was a total loss filed against this vehicle. Checking into thid further, I found that the total loss was filed by USAA, in direct violation of their settlement agreement.

I brought this up with USAA, which, as with any dealing with USAA was an ordeal. However, I did get them to say they woudl retract this so that it was as though it never happened, and that I would receive a copy of their communications with the State of Montana.

I again gave them time, and then called back. Upon calling back, I was informed that it was against USAA policy to provide this information to claimants. When I pushed on this, I did finally get them to agree to send me a copy of this letter. Several days later I did receive a copy of the letter.

I then followed up with the State, only to find out that they had not received any communication from USAA, and that my title had not been corrected.

USAA treated me rudely, threatened my property, violated their settlement agreement, and fabricated communication with the State. Apparently this is how USAA demonstrates that they "live by the values of service, loyalty, honesty, integrity - and doing the right thing because it is the right thing to do, " the values their CEO purports USAA stands by.
