Breach of contract/fraud

I purchased a car on June 6, on June 18, $1000 later the car was repossessed. I was told I was in default of my loan.

Purchased a vehicle on 6/5, salesman Tony, told me I needed $700 down, but I only had
$400, at that time told me to go and get a payday loan, but i was able to borrow the balance from family and friends. He subjusted that write a check and deposit the money as soon as possible. Which I did on 6/9/09. I had a unauthorized debit $33.98 that went through before they ran the check (this matter is being handled by the bank now). The check for the down payment came in and was returned by the bank because there was a balance of $670. I drove to the dealer 's car lot to pay the full amount in cash for the down payment. The loan manager Michael Tolbert stated he need copy of the bank statement to show I had funds in bank at the time I wrote the check, which i had previously advised him that I had to cash my payroll check before i made the deposit. I also had to transfer money from my savings to my checking account as well as get the loans. Therefore he knew the money was not already in the the account because i for warned him before i signed all the paper work for the car. Monday morning Gail from the finance company called me at work and advised me to take the money back to the dealer. When I called to verify what time they closed, Mr. Tolbert told me he did not want my money he wanted the car back. I ask him why and he stated the check was returned and when that happens he wants his cars back. I did not understand this rule or law. On Wednesday I called him back again to ask what time did they close, and to make sure all paperwork would be completed when car was returned. He ask what paperwork, I advised that I needed the returned check, balance from insurance, and to make sure by checking account was not debited for the first payment on 6/18/09. He told me he did not have the check (stated bank shredded the check), nor did he have any knowledge about the balance of insurance premium, or debiting my account. On 6/18/09, around 11:45 pm, the car was repossessed, and my account was debit for the first payment.

They offered me a $25 gift card!!! That I cut up and sent back with a intent to sue letter!

I have filed complaints with the BBB/Texas of Transportion/Attorney General of TX/AZ, Consumer Protection/FTC/FCC, and contacted an attorney. I gotten positive responses from all.

I have nothing but I time on my hands on the bus line!
