Fraudulent billing reposession ripoff

Constant Harrassment Horror...

In May of I purchased a used vehicle that was financed through Chrysler Financial. I received a call 45 days later telling me my payment was late, even though I hadn't received anything telling me where to send them. The conversation was most unpleasant.

In September of I received a statement for my monthly payment.instead of the usual amount, the statement requested a payment of $20.21 and showed a huge payment posted to my account of over $1,500 dollars. I called Chrysler and spoke with their representatives on two occasions and was assured that the large payment came from a refund on an extended warranty I had purchased. I sent the $20.21 in a money order to Chrysler Financial. Two weeks later, I received another late payment call and was told that I owed the normal payment plus late fees. I pulled my copies and told Christina what had happened. She said there was no payment in that amount and that I owed the normal payment. I inquired about the money I'd already sent. It was never applied. I asked to speak to a supervisor.

The supervisor, Chris, was rude to say the least. He screamed at me about being able to afford my car. He told me that he saw no errors and would not comply with any of my wishes to correct the problem. I requested a payment coupon book instead of the monthly statements sent by Chrysler Financial and was told that the "check is in the mail" story wouldn't work either. It was my credit and he didn't care were his exact words. I was furious.

This went on through October and I was constantly getting calls for "late payments" when my payments were being made and the late charges kept on accruing. A very nice gentlemen called Ben, called me on my job again about the October payment not being received. I explained again and he assured me it would be taken care of and that there had been problems with their mail ever since September 11. I wonder why! I was told that the September & October payments would be taken care of and not to worry.

That no one was going to take my car.in November I got another call on my job saying that my payments were behind again and they were going to "pick-up" my car. I had receipts showing payments sent to Chrysler Financial. At that time, Mr. Donato got on the line. He was supposed to be the Manager over collections. I explained everything that had happened to him. He agreed to "defer" the September payment to the end of the note due to it being CF's mistake. When I faxed all the paperwork back that day, I assumed everything was fine.

At 3:30 A.M. On the morning of December 16, I heard a loud crash on my front porch. I had fallen asleep on the sofa. I grabbed my gun, flipped on the light and jerked the front door open. There standing on my porch was a REPO MAN for Chrysler Financial and he would have gotten away with my car had my son's car not been parked behind it in the driveway. I held him at gunpoint and called the local police who responded immediately. There had been no repossesion reported by anyone and he was told to either leave or face grand-theft charges.

Before the REPO MAN left, I asked for the name, address & phone number of his employer. I showed him the receipts, including statement stubbs from Chrysler Financial, showing that I had made EVERY payment on my car. He apologized profusely and left. I spoke with his employer and was amazed at the story I was told about Chrysler Financial and some of their practices. She assured me that no one from her company would answer another CF request on my account.

Later that same day, December 16, I received a call that my Grandmother has passed away and left immediately to go out of state. I had a friend sit with my house to feed my animals. I left my car in my fenced backyard and drove my son's car to attend the funeral services. My son was being brought in by the Red Cross from his current Military station in Ft. Bragg, North Carolina. When I got back, I was told by my house sitter that another REPO Man was caught trying to cut the lock off the gate to the back and was again walked off the property at gunpoint. I called the agency again and was assured that it wasn't them and the lady was furious that Chrysler Financial had more than one agency working the same account.

Two weeks later, Mr. Donato called back and asked me if I enjoyed meeting his REPO MAN and the nightmare started all over again. This man screamed at me, Where is that "F-ing" car and the list goes on and on. "Stop doing drugs and pay your bills... Deadbeats don't deserve nice cars... That's my F-ing car... Where is the F-ing car? It was horrible and again, I was on my job when this happened. There were several witnesses. Today is May 13 and I've sent my payments via Western Union Quick Collect since that time. I still get 10-15 voicemails a month on my job about late payments. I have caller ID and I just erase them.

My payments are due on the 12th of each month and considered late after the 22nd according to my contract. The late charges are still appearing on my statements and they don't like much equaling an entire months payment. They have trashed my credit, therefore, I can't refinance anywhere else and get away from them. To this day, Chrysler Financial has never deferred the September payment and my account has been a mess ever since. All I ever wanted was for them to correct their mistake and make ammends. I did as I was asked to do.

This whole affair has been a tortorous nightmare. No one there cares and I had to have Privacy Director installed on my home phone to keep from being harrassed and upset in front of my children. I don't understand how these people can stay in business. I don't understand why the government hasn't investigated and done something. I carry the last 10 months of Western Union wire receipts around in my purse so I will have proof of my payments at all times and I'm scared to leave my car parked in my own driveway. Is there someway to sue these people for this?

I know this has happened to more people than just me. Can anyone help end this nightmare? I am a good person. I am a single mother with a son 26, a son 21 currently in Korea with the Military, a son 12 and a daughter 11. I can hardly wait to get it paid off and I pray daily that I will be blessed to do so quickly.
