Retaliatory Repossession/Verbal Abuse/Third Party Disclosure

We financed a used car through this company which at the time we financed it was called WFS Financial. Wachovia came in from the East Coast and purchased this company as they did many other companies. At one point we did get behind in our payments temporarily. Although I brought the payments up to date they still insisted that we still owed around $60.00 to $75.00. The amount would change periodically.

When we would ask them why they couldn't tell us why they would just say you owe it, so pay it. I scheduled through my bank to make the payment each month to this company. A payment was made each month electronically, but they would still call and say we owe them money. I asked several time for a reconciliation of our account but they refused to send me anything in writing.

All contacts were verbal and always verbally abusive. They started calling me at work and harassing me and my co-worker. Even after I told them several times not to call me at work. The even went as far as to call my boss on his cell phone. My boss refused to speak with them. They would call my home and speak to my children.

I finally wrote them a letter and told them to cease verbal communication especially at work. I told them to communicate with us only in writing. I asked for print out of my account and account reconciliation. I told them to please show me how I owe this money. The refused, they would just say you owe it so you need to pay it or else. They once called and told us to pay $60.00 or give them the car. My bank would send them the payment electronically and they would always say they didn't get the money. Although my bank would give me confirmation that the money was sent to them.

Finally one morning we woke up and the car was gone. They stole it out of our driveway. When we called to talk to them about this we were told by the supervisor that although we had been making monthly payments they show a past due amount and the only reason they took the car was because I wrote the letter to them to cease communication. So basically they are saying they took the car in retaliation to my letter. I had every right to send them that letter they were putting my job a risk and they were practicing third party notification, which is illegal.

It is very embarrassing for your boss to be receiving phone calls from your finance company. Now they are holding the car hostage and refusing to give us the information on where the car is and how much we need to pay. They told us that they haven't made a decision on weather or not they will give us the car back.

My advice to anyone looking to finance a car is to avoid this company at all cost. It is not worth it to go through what we have gone through. I wish I had known what kind of a company I was getting involved with. I have another car loan through Citifinancial and the difference between the two companies is night and day. I have been in Accounting for twenty years and I have dealt with all kinds of financial matters, but I have never dealt with a company such as Wachovia. No wonder they went down and had to sell out to Citibank.

We are with out the car so my husband had no transportation. They are purposely ruining our credit. They are adding a numerous amount of fees to our loan to the point that we will not be able to pay or get the car back. So now we will have repossession on our record. We are currently on one income due to the condition of the economy. So now that we only have one car my husband can't even get to a job if he gets one. So this only causes us further financial damage.
