Ebay's Vehicle Purchase Protection

EBay's Vehicle Purchase Protection Prior to purchasing the vehicle, seller disclosed in written Q&A that the transmission was serviced, and there was a leak somewhere in the transmission. He claimed that it was not the drain plug.

After signing the bill of sale, we were then told by seller that he had made a final payment by mail to the lien holder - PNC bank earlier that week and we would have our title in one week. We agreed that in one week we would meet in Media to sign over the car title.
After two weeks and several inquiries to the seller we discovered that upon us purchasing the car there was still a lien on the vehicle. It was not satisfied by he seller until days after selling it to us.

We finally received a phone call on Saturday, Sept. 6th that the title was delivered to the seller. We made arrangements on Sept. 8th to sign over the title.
The vehicle was not driven for those days until title was received. The following day I drove the car to work approx. 10 miles the car broke down. It would not shift into any gears. We hadn't even had a chance to take the vehicle to our mechanic and have it inspected. It was driven less than 1 day.

We then asked the seller if he had had problems in the past, and asked to speak to the garage where the seller had it serviced and the seller refused to give us the information.

The vehicle has been taken a local authorized VW mechanic and was discovered that the transmission was broken beyond repair and must be replaced. The estimate has been given to us as approx. $1500.00.
Being left without a vehicle for 3 weeks and then only getting to drive it one day and now again having the car sitting and not drivable has been a terrible burden on our family, not to mention the inconvenience, frustration and expenses occurred.

We have contacted seller the very next day (after title was transferred) and asked to receive 50% of reimbursement of repairs or a full refund. We have not heard any response from seller.

In summary, Due to the fact the seller did not have the title to the vehicle at time of listing or at the end of the listing we could not register nor inspect or drive the vehicle until we received the title witch was on 9/8. We attempted to drive the vehicle to work (10 miles) on 9/9 and the transmission failed.
Ebay's Vehicle Purchase Protection Situations for Which Protection is Offered

2.) The vehicle has an undisclosed or unknown lien against its title.

I had to wait almost a month for this seller to recive the title from the bank he had a loan through.
7.) The vehicle had undisclosed engine, body, transmission, and/or frame damage at the time of purchase that will cost more than $1,000 to repair.
Trans was shot. Ebay's reply to my claim was Oh he said that the trans had a leak! A leak not a $1600.00 blown trans. And you did recive the title.
What a joke!
