It all started about 5 years ago, we leased an e-320 that was a sales mangers car, It all started out nice, we had a rear ripped tire that they exchanged, than our windsheild squirter did not work, found out that it was torn away from the washer unit, Then the cup holder when we opened it was filled with melted goop and did not work, They got the goop out but cup holder was never fixed (cups all ways fell out). That was the first week not to bad, then the fun began..
After 2 months the steering wheel started squeaking, so we took the the car to there sister dealership as we were told we could do since it was 25 miles closer to our home, even giving the person to talk to a Rob Picone, Well he seamed nice enough and told me the rack & pinion was shot and they rebuilt it. About 4 months later the same thing happened so they rebuilt it yet again,
about 6 months past and guess what it happened again,
At this point other things started to make noise with this car, The cats were no good the car was very loud, guess what 2 times to somewhat to correct this issue (never done to our satisfaction). The rear end was clunking did this twice, and still doing it. Well this time they replaced the rack & pinion with a new unit (DO I HEAR LEMON LAW) quess what it still squeaks.
When i spoke with the tech from the dealership he tells me this happens with the demo cars all the time, I was like Demo car' He told me he read into the cars history and in fact it was a loaner / rental car, He was like you were never told this and i said no, I would never have purchased a loaner/rental car we all know how they are treated.
So at this point i called the dealership and ask if you can rent cars and they said that they rent out there loaner cars (I HAVE A COPY OF THERE LOANER / RENTAL AGREEMENT) now it all made sense why we had so many issues, So i called my salesman Vinny Ciuffo He still tells me the same thing that it was used by a manager. I had another dealership run a car fax and it said a corparate fleet vehicle.
So i call the dealership back after finding out NYS law reads that if the car was used as a rental we must sign a document stating this fact that we know that we were informed of its past use WE WERE NOT NOR DID WE EVER SIGN A FORM... Dealership tells me to go take a walk that they would not even service my car any longer. So i go to MB Finanical the bank well i go over with them all these facts and tell the dealer to make us happy, I was called by some guy named Hans from Smithtown dealership and his exact words were i dont give a dam what they said he was doing nothing more with this car well this went on for 2 1/2 years and MB financial did nothing.
So i went to the NYS Attorney General they said i had a good case well this went on for 6 months, and then i get a letter from them that i should sue them i have a great case, But that they are only a mediator and that they can only recommend to me what i should do. The dealer ship said i had buyers remoarse maybe they should have check there records since i was complaining from almost day one.
I need somebody who can start a class action suit against them, Do you know how many people are out there with these cars that were not sold legaly, They own 2 Mercedes dealerships plus a Bmw dealership and as per there own tech they have been doing this from day one. This was not 5000.00 car but 40,000 this is in the millons of dollars involved in this fraud. When my ballon payment came due someone told me to just turn the car in and let them sue me so this will come out in court, (not sure if this was right but i was tired of paying for a car that was a peice of junk)
So for the last 5 years i drove a car that drove like junk sounded like hell clunked in the rear and looked like hell. I forgot to mention that on its last service i had them detail the car and they burnt the paint with the buffing wheel (This is documented on there service tag) so they said that they would re detail the car which they did but the swirl marks never went away, The only way to fix this is to reclear coat the car which the service manger said he would do if the re detail did not work, Another empty promise. (BLACK CAR WITH SWIRLS EVEN AFTER WASHING IT IT LOOKS LIKE THE CAR WAS SANDED WITH SAND PAPER)
So i want what NYS laws says a full refund every penny i paid to them not one cent less. Again i tried for almost 3 years and was just shoved around, I want them to be exposed as the frauds that they are and to come clean with all there customers, who were not sold what they thought they were buying. Somebody please help me
