Ripped off by Windham Auto Sales in Derry, Fraud and Deceit

I purchased a Subaru Impreza 2.5RS from Windham Auto Sales on June 7th with a check from my credit union. Exactly one week earlier I had visited the dealer to look at the car, I test drove it and thought the clutch felt "spongy" near the floor and I heard a slight noise, the salesman (Mark Norris) assured me that these were most likely normal issues for the car and that they would be addressed when the mechanic checked over the car.

I then called back the next week to inquire about the car, Mr. Norris told me that the problems had been fixed, when I asked what specifically was wrong, he told me that they had removed the heat shield in regards to the noise and had bled the clutch. We test drove the car and everything appeared fine.

A couple days later the noise came back and a coworker informed that my car was smoking. When I checked the oil I noticed that the oil had been overfilled. I promptly took the car to Jiffy Lube of West Lebanon, NH and had an oil change performed. They informed that my oil had been overfilled. Immediately after the oil change, I noticed that the noise grew louder and more noticeable.

The next day (Saturday June 14th) I brought the car to Browns Auto of Unity, NH where I was informed that he believed I had a spun bearing in the lower end of my motor and that the oil had been overfilled and most likely with a heavier weight oil to hide the noise. I had only put 400 miles on the car and most of it was driving home from purchasing the car.

I immediately contacted Windham Auto Sales and spoke with Mr. Norris and was told by him that he could do nothing that day and he would contact the owner of the business and I would be contacted. I received no call by late afternoon on Monday so I called and was told that the business would do the work for $500 if it was in fact a bad bearing. I replied that I believe the car was misrepresented and I was lied to about the condition of the car when purchased and also deceived by the overfilling of the oil. Mr. Norris claimed to have no knowledge of any wrongdoing. He suggested I talk personally with the owner of the business. I left my name and phone number and Mr. Norris assured me I would be contacted.

When I received no call back soon the next day, I called to try and speak with the owner or manager. I was informed that there was no manager and that they (the salesman) were all the managers, even though their website (Windhamautosales.com) states otherwise. I was told the owner was not in. I repeatedly tried to contact the business owner over the next week trying to resolve the issue, and even though I often left my name and number with the salesmen (Mr. Norris, and 2 others named Jimmy & Steve) I received no return call.

I continued to call over the next week trying at all times of the day to reach the owner, however I was always told he was not in or had already left for the day. I finally got a response when on Saturday, June 21st I talked to a salesman named Jimmy who assured me he would contact the owner. He then called me back and stated that for $1000 they would fix any problem with the car and that they would do no more. I was recently contacted by the manager and he made the same $500 offer as stated earlier and I refused again still believing that to have the same mechanic/dealership swap my engine that overfilled my oil to hide a problem would be foolish.
