Won't pay on claim Rocheste

My son (age 23) was T-boned by a 17 year-old girl who ran a stop sign. She was covered by Progressive, and was cited for failure to yield. She had front enddamage and my car (driven by my son) had damage all the way from in front of the front passenger door to the back—nearly ripping the bumper off. Progressive took action right away, but only to have MY insurance pay THEM, because their 'investigation' concluded that my son was at fault because the girl said she thought that she saw his blinker on and that he was going to turn. He didn't have his blinker on, and was NOT making any moves to turn, PLUS Miss 'Duh' was yapping on her cell phone and didn't even slow down at the stop sign (she was skipping school and was in a big hurry to get back for class). They took it to arbitration, and I won. I called them repeatedly, but the adjuster who's number I was given was always 'on vacation' according to their voicemail. Everytime I called and was asked to enter the claim number that I was calling about, I either got that voicemail, or was completely disconnected. I then called a phone book number for Progressive and after several button pushes and a few transfers, I finally got who I needed. I asked them how the claim was going, and they said that they didn't have any information back on it yet&LIES! I then told them that MY insurance company had gotten the word TWO WEEKS earlier, so I KNEW that they had the information, too. Then they fessed up and asked for my phone number so they could contact me (they had my home, work and cellphone numbers when they thought they'd get ME to pay!). It's been nearly 3 months now, and after several more calls, they have agreed to send someone out to assess the damage on my car. It's an older car, so I didn't have full coverage, and the estimates were much more than the book value, so it's just been sitting—undriveable for the most part. Since it's take 3 months just to get them to take responsibility for the accident, I'm sure it will many more months to actually get them to pay. I'm also sure that it won't be nearly as much as I'm supposed to get. I'm gearing myself up for a lawsuit if need be... A look around the Internet shows that Progressive needs to be shown that they can't get away with these kind of rip-offs.
