Did not Refund my Fully-Refundable Extended Warranty

So I bought a new 2006 Honda Civic from Stevens Creek Honda, and added a $2500 extended warranty (5 years). I was told this warranty was FULLY REFUNDABLE if I did not file any claims on it.

A year later, the car was totalled in an accident that was not my fault. It was considered a total loss, and my insurance paid me for the value of the car. Of course, I would think I would get my $2500 back, since I did not file any claims and could no longer use the warranty.

I go into Stevens Creek Honda, and after waiting 30 minutes to speak to someone in finance, I was told that for my issue I had to talk to the finance manager who would only be in the next day.

The next day, I wait this time about 40 minutes, and then was told I could speak with anyone. The guy told me I had to first cancel the warranty. I needed to mail by certified mail a form he gave me, along with my entire extended warranty booklet. I no longer had the booklet... He told me I had to contact the Honda Finance Department and have them send me the booklet. He told me it could take 6-8 weeks.

6-8 weeks later, I finally have all the information. I go back into Honda to make sure it is all correct... The finance guy laughed at me and said I also needed the original contract. I asked for a copy, since I'm sure they must have one there. It took them another week to pull up this contract.

Finally I mail it all in. 6 Weeks later it's cancelled. THen I have to fax in another form to receive the refudn. They tell me it could be another 6-8 weeks. When I receive a check in the mail (4 weeks later), it's for around $700 instead of $2500. I contact the finance corporation... They tell me that if Stevens Creek Honda told me I'd get all of the money back, they would have to refund it to me themselves.

I go back into Honda. After waiting 30 minutes to speak to someone in finance, it's the same guy who laughed at me (an Eastern European gentlemen). I tell him I only received $700 rather than the $2500, and that I guess they owe me the rest. He laughs again even harder, saying they never refund at the store. He says "Well yeah... It hasn't been 5 years now has it." I ask "So... I have to wait 4 more years before I can receive all the money?" He says "Well now you can't recieve it at all, since you've already cancelled the warranty!" I cannot believe it!

I go home and call the Finance Manager... An Asian gentlemen. He is pretty rude on the phone, and doesn't understand why I would think they owe me the difference. I say: "When I bought the car, you told me it was FULLY refundable. Now you're telling me it's pro-rated? And you yourself told me to cancel it. Now you're saying I can't get the refund because it's cancelled?" He says yes. He asks me to show me in the contract where it says it is fully refundable. Of course I sent my copy in, so I can't show him anything.

I wrote a letter to their offices... And it only led to the finance manager calling me again to explain the situation again... The rest would never be refunded.

So that's that. I got only $700 back, which means $1800 is down the drain. They told me I had to cancel the contract to receive a refund, now they're telling me I CAN'T receive a refund since I cancelled the contract. It is unbelievable.

PLEASE PLEASE do not buy the extended warranties from Stevens Creek Honda. They wheal and deal them to you, and don't follow through with the refunds. I can't believe the way the treated me when I was in the store. Waiting for 30-45 minues every time, only to be laughed at and brushed off.
