Putt Putt Auto Dealer Contract Breaches, Consumer Fraud, Bait & Switch

I visited a dealership in Apache Junction to purchase an automobile through finance. The sales man was real eager to sell me any car that I chose. I chose a '97 Geo metro 4 door sedan. We test drove the car and we went in to close the deal. The salesman promised that, "O, if there is anything wrong with the car in the next 30 days will take care of it" He also bragged on how all the vehicles go through a mechanical evaluation, and only quality vehicles are chosen for the lot.

After completing credit checks, title transfer and everything else but the signing of the contracts he switched cars on me without my knowledge. Same car, different year a much less quality vehicle. The initial test drive was fine so I accepted and closed the deal.

Upon signing I noticed 1 specific detail which was missing on the purchase (which I should have thought about and checked the contract too) order, which was the statement that the guitar I had given him for CASH COLLATERAL in complete good faith that it would be returned to me when a trust was obtained between me and the dealership. I then amended the order signed and returned to the rep who also signed. The next day (before the mechanical problems occurred) I received a phone call from the rep stating that she disposed of their copies and she needed me to return and resign the contracts, so I did just that. I have since been called a liar and told no such thing happened when in fact I have witnesses that they made me sign a second copy and refused to give me a copy.

Two days later I replaced two severely worn tires and noticed disturbing noises coming from the area around the tires. I thought it was the balance but after pro-evaluation it was told to me that the bushings were severely worn and needed immediate replacement. I requested a service to be performed to cure the problem, which is a major defect as stated by state implied warrantee, which I do have. I was given a statement" we are under no obligation to fix anything but you can call our corporate office and see what they say, " there is no corporate office. I have called that number several times only to be responded to by a rep. At this dealership in AJ.

Then the transmission broke in some manner (which was not explained to me when I requested) and I was forced to pay to get the car to the lot ($40) when they have tow company's that they do regular business with. I missed out on over $200.00 (two hundred dollars) due to the absence from work, and much stress to me and my family. At that time I requested rescission and cancellation, or a different vehicle that was in reasonably good condition. I was strictly denied.
I was also dooped into another vehicle without my knowledge and told these vehicles are checked. What a bunch of bull.

Dealership in question is Putt Putt Auto sales 2281 w Apache tr.

Sincerely Kenneth T. Liby
