I agreed to purchase a Carrier reefer unit from S.W.A. T for $1500.00. I then asked if he would have any problems with holding the unit for approximately a month or two until I could be in the area to pick it up. His location is 3 hours from my home and I am a truck driver and not regularly in that area. I agreed to give him half of the balance with a credit card payment by phone if he agreed to the above terms. He stated he had no problem holding the unit and that he would then run the credit card number I gave him for $750.00 with the balance due upon receipt of the said unit.

Everything was fine until I received my credit card statement showing a purchase from SWAT Auto in the amount of $1500.00. I immediately contacted Dan. He stated that he was very sorry that it was run incorrectly and he would send an email to the company to fix the charge. I waited another week and still the charge was not reversed. I then decided that instead of waiting for a reversal I would just let the payment stand. It had now been over a month since our transaction and I was due to pick the unit within the next couple of weeks as it was. I spoke with Dan to this effect and let him know the day I would be coming to pick up the unit. He noted that the unit would be at his storage warehouse and the unit would be secured to a pallet, and that there should be someone there to help me load the unit onto my trailer.

Unfortunately this was not the case, and we were not able to load the unit onto my trailer. Joe of Nuts and Bolts who leases part of the warehouse helped me attempt to move the unit. When the unit was not able to be loaded Joe then stated he could mount the unit if I wanted to bring the other trailer back down..

I then spoke to Dan and stated what had transpired and that I was unable to load the unit. Also that I was going to have Joe with Nuts and Bolts mount the unit on the trailer when I was able to return with the trailer. Im noting this because when the matter is in its final stage of not being resolved Dan complains about the fact it took over 2 months for the unit to be picked up. Which would only be an issue if he had not agreed that time was not a problem through the many, many conversations we had.

When the job was finished I returned to take possession and found that the unit would not cool as Dan had guaranteed. I immediately placed a call to Dan at SWAT Auto. I spoke to Jerry who is the general manager. Unfortunately he was unable to reach Dan. I told Jerry that I needed this problem resolved ASAP that I needed this unit for the following day for a load to the east coast in which I had already committed to. He advised me to take the reefer unit to be repaired and to follow up with him or Dan the following day. I would have been more then happy to bring the unit to their shop (which was only miles away) had Jerry stated that he wanted me to do so. I say this because Dan later states the work should have been done at his shop.

I did just that and had the unit repaired that very night from Jade of Fleet Climate Service LLC in Plover, WI. The following day I contacted Dan. He requested that I forward him a copy of the invoice which I did. He then stated that I was overcharged and should have only been charged a fraction of the price for the repair and that he was going to contact Carrier (the manufacture of the unit). We spoke several more times and finally on February 7 Dan agreed he would pay $600.00 of the $944.20 invoice. He stated he was going to give the check to his Carrier representative and they would present the check to Jade with Fleet Climate Service and research the fact Jade was overcharging for Carrier parts. I agreed to accept the partial payment for the repair as a final resolution to our agreement.

I then contacted Fleet Climate Service within a week of that conversation with Dan and inquired if they had indeed received partial payment for the repair and they had not. I then placed another call to Dan in which he stated the check was in the mail.in the weeks to come I placed several more calls to both Fleet Climate Service to see if they had yet received a check and then of course to Dan when they stated a resounding no. Many times I would get his voice mail in which I would leave messages and then never receive a return call.

Then on March 4 I finally reached Dan on the phone and told him they never received the partial payment and I wanted to know what he was going to do from here. He noted he would inquire to see if the check had indeed been cashed and return my call. I then called him the next day in which he acknowledged that the check had not been cashed and he would cancel that check which would take 24 hours and reissue a new one and UPS to my home. I was so grateful to finally see a end to this mess.

Of course the check never came. On March 10 I placed my final call to Dan in which he again said CHECKS IN THE MAIL. We then got into a fairly heated discussion in which he stated he would do nothing for me and that I could take him to court if I wanted. My wife then contacted him the following day and got the same response. He back tracked and went back on the $600.00 payment he had been promising for over a month. Do not buy from this company. They are dishonest and do not honor there agreements.
