In 2005 I was rear ended at a stop light in Delaware while on vacation. My wife was hurt (didnt have her seat belt on and banged her head and hurt her neck) and my car was totaled.
The Geico adjuster totaled my car without even getting out of his car to take a closer look. He told me to rent a car until I got the check from geico to buy a new vehicle. Then he tried to buy my junk car. It was getting seedy so I told him I would get back to him.
After a month of waiting for a check, I received a letter from geico stating they were not covering claim. Come to find out, since I was from New York and the claim was in Delaware, geico rolled the dice hoping I would not pursue the claim. Now I'm not only with an injured wife and no car, but a month worth of car rental fees. I wanted someone dead at this point...
They rolled craps, I went back down to Delaware and filed suit against the vehicle owner and Geico. After about a year and another $1250 of legal fees, I realized the state of Delaware Insurance regulators were not only fine with Geico ripping people off, but the courts would do nothing to help me without an attorney. So, after many many phone calls and a lot of begging I was finally able to find an attorney in Delaware to take my case. The attorney with almost no effort was able to get me $11,000 which didnt even cover the cost of my car, never mind my $1000 car rental, $3250 in legal fees and two years of empty pockets and fustration.
It floors me that states allow insurance companies to get away with this crap. I know politicians have limited values and low or no moral charachter, but as far as Im concerned this is illegal. How much damn money are the insurance companies pumping into governments to convince regultors to turn a bling eye to these crimes. Crimes by wealthy against usually the poor.
Something has to be done. Someone needs to step up to the plate and hold these companies accountable for their behavior. I think its time some top dogs not only with these insurance companies but in top state offices spent some time in prisons. Whats it going to take for regulators to stop this crap, a sniper, a blown up insurance building. When is it going to end.
